Stop the ban on Surrogacy in India

For many couples India is the only hope. And it's life changing for the surrogates who CHOOSE to do this - as it should be!!

Please do not ban foreign nationals from going to india for Surrogacy.

It should be the woman's decision, NOT the governments decision!

Please allow couples from a road to realise their dreams and complete their treatment In India

Many judgements of the Human Rights Commission and Hon Supreme court and District Courts of India show that this is against the rights of the women of India. Without consultation with patients and stakeholders this decision cannot be made in a democracy.

i support this petition!! the era of bans is over!! in this day and age the govt would be foolish to think that banning surrogacy or foreigners is a smart move!! the ban will only drive things underground!!

Everybody has equal right to opt for surrogacy in India. Foreigners cannot just be limited by boundaries made by humans. Its good that they use Indian health services. Surrogacy is one of the reasons that is used in medical tourism in India.

In country like India, commercial surrogacy is a win-win situation where on one hand commissioning parents who have no other choice to have a child get hope and at the same time a surrogate who is in need to stabilise her economically situation gets hope. Both women who fully understand the situation help each other. Even though there are many clinics in India who might not be following this practice ethically, but banning is not the solution. Clinics like Dr. Patel's in Anand, Gujrat who are doing a great and transparent job get affected. So request you to regulate instead of banning commercial surrogacy.

Mahendra Patel Following opinion is offered for kind consideration of GOI and Hon'ble Supreme Court,since I have faced infertility problem of my children and has understood some of the connected issues in last 3 years. _____________________________________________________________________________ Government need to understand that surrogacy helps to have win win situation of having child for parents facing Infertility problem and for surrogate to have monetary benefits. Goverment need to EXEMPT PIOs, OCIs,FROM THIS BAN and may introduce regulatory mechanism to avoid exploitation issue,if any, actually happening in few cases. PIOs and OCIs are basically Indians having feeling for motherland and also contribute in some way to own motherland.Such ban on PIOs and OCIs will possibly make them FEEL away from motherland.Permitting them for surrogacy will help to have their continued bond and feeling with relatives and India as motherland, which is need for our country. PIOs and OCIs NEED to be permitted for SURROGACY in India.Govt may review imposing BAN on original NRIs.HOWEVER, this also requires open minded assessment considering overall benefit to needy poor surrogates and childless parents. Committee appointed by Government involving representatives from medical,legal, health etc may review matter examining some of random cases of surrgates actually performed during last few years and work out REGULATOTY MECHANISM to ensure MINIMUM PAYABLE AMOUNT to SURROGATES, custody of hadicapped child etc . Regulatory Mechanism may be worked out to make this legalised as part of MEDICAL TOURISM. It is strongly recommeded to permit surrogacy to PIOs and OCIs. I know that some of the surrogates have properly utilised money received out of surrogacy for good purposes such as build small house for family, educate their children, earn monthly livelihood keeping money in TDR, Treating close family relatives for serious disease, helping parents/family members for acute need etc

A prospective surrogate mother's face completely lit up when she told me about seeing the joy she was able to bring to a couple by helping them have a child. This was such a profound experience that she was eager to do this for someone else. This was clearly not a woman who was being exploited, but a strong woman who had compassion for complete strangers, and took pride in being able to help them, while helping her family at the same time. My beautiful daughter was born through a surrogate mother. I will be forever grateful to our generous surrogate, fantastic doctor and clinic staff who made this dream come true. Our family will always have a strong tie to India. Please allow other surrogates and foreigners to help each other achieve their dreams!

Such a shame! We have 4.5 year old twins born through surrogacy in India and hold our surrogate, Doctor and India very close to our hearts. Please reconsider this ban!

The doctors should take care proper treatment is given. Banning it is no solution but a loss to all. It's the best way to escape responsibility.

Wonderful gift for IPs and surrogates. We have a love for India because of our surrogacy journey. And we were able to complete our family.

Indian surrogacy is a beautiful and valid way to build a family. After exhausting all of our other options and enduring years of crushing disappointment and loss, we were blessed with our adorable little girl with the help of an amazing surrogate mother in New Delhi. Banning surrogacy in India is a terrible idea, as it is a mutual humanitarian act that changes lives for the better. We adore and respect our surrogate and tell our daughter often of her special birth story and the compassionate woman (and friend) who gave her a safe place to grow. Please don't think of us as "foreigners." We are all human and therefore share the same fundamental right to have families. Please don't turn anyone away!

This should not be banned as I totally agree with the words written in the paragraphs. My own family are going through this and the woman in India acting as the saragocay have done so out of there own choice.
