Dr. Barios defrauded all the lot owners by illegally forming an HOA with owners consent and making unilateral decisions. He also billed lot owners for ridiculous HOA dues which he he stole for himself without using the funds to properly maintain the property.

Me and my wife own lot A25,please help us to not loose our investment, by helping the Marlett’swith getting rid of the unscrupulous attorney Dr.Barrios out of his so called ownership of our development, not his. We where going to build a house there but will not until he is gone! He stole our development at lake Apanas, we lost everything like many others, please don’t let him do it again, he should be arrested for what he has done, people will not keep investing money here if this is not made right!

My wife and I own lot A-25 since the beginning of RSR , we hoped to build a house there but will not even consider it until Mr. Barrios is removed from any decision making power, he has destroyed our investment there! Our only hope is that you help us by helping the MARLETT ‘s restore this community! Otherwise our investment will be lost as it is in another development that Dr. Barrios has cheated us out of called Lake Apanas , we like many others like Graham Smith have lost a lot of money.please help us get rid of this unscrupulous attorney so that we can build our dream houses!

I am a US citizen and active real estate investor who has been visiting and investing in Nicaragua since the late 1990's. I have recently been exploring opening a call center in the Country, but those plans have been put on hold as a result of the blatant fraud perpetrated by Mr. Barrios and the apparent lack of legal recourse to do anything about.

We are US citizens and purchased Lot B-39 in 2006. We intended to build a home there and spend our retirement winters in Nicaragua, but the recent nightmare of issues associated with Mr. Barrios have put that plan on hold. We dealt with Mr. Barrios when we purchased but had no idea he had subsequently played such a significant role in the property. We implore you to work with the government of Nicaragua to clear up this mess. If Nicaragua truly want to attract US investors, they would be wise to set these matters straight.

We first visited Nicaragua in 2008 when we rented a car to spent almost a month driving throughout the country, sightseeing and looking for a future home. When we fell upon Ranch Santa Rosa it was the best of anything we had seen: beautifully developed, with excellent infrastructure and welcoming professional staff. We felt safe purchasing a lot because the developers were Americans, had hired such good staff and made a truly professional job of building the roads, utilities and community pool, cabana and facilities. We fell in love and subsequently but unfortunately the remaining lots were far beyond our means. Later the same year a resale lot came available and we bought it - lot A7. We paid the staff to landscape the perimeter of the lot with trees to give them a head start before we built.
We returned in October 2015 with drawings in hand for a possible home and to check on the status of the plantings. We were dismayed to see disrepair, poor maintenance and a non-functioning water system. But the manager allayed the worst of our fears. A few months after our visit we were informed that Mr. Barrios had fired that manager. We were distraught. Mr. Barrios had been represented to us only as a local lawyer who could arrange our tax payments to the municipal authorities - we had no idea he had ANY power in the development. We found him very difficult to deal with and as soon as we could we found alternate means of paying our property taxes. Over the next few years Mr Barrios’ influence blossomed until he became the sole voice and power of the project.
We have never been notified of Home Owners Association meetings and never been invited even to comment on activities of the Association. Clearly something was wrong. Our home owners’ payments were not being well managed and we were denied input.

We are US citizens and purchased lot B34 in 2005 and have maintained annual property taxes current and paid HOA fees to the developer until Barrios' unscrupulous activities came to light last year. Please support our effort to defend our property ownership and to create a legitimate functioning HOA.

My wife and I are US citizens and own lot B-29 at Santa Rosa. We are very disappointed in how Mr. Barrios has managed to mislead so many investors over the years. We have invested in other projects in Nicaragua and love the country, but will not invest any additional funds for the time being given the lack of accountability for unscrupulous managers. We hope that the Nicaraguan government will respond in a favorable way to restore confidence in the rule of law in Nicaragua so investors won't be run off.

I am a U.S. citizen and have owned Lot c-5 in Playa Santa Rosa since June 1, 2005. The covenants and restrictions declared that a legal HOA would be created and that I would have rights to the common property. This has not happened even though I have paid all taxes due and maintenance fees requested until it was apparent Mr. Barrios was not reliable and was misappropriating funds and had seized the common property. Further Mr Barrios has not maintained the property and let the infrastructure deteriorate. The assistance of the embassy to assist in the restoration of the rights of the original owners would be greatly helpful and appreciated.

I am a US citizen and PSR owner for a decade. I have always paid both taxes and assessments in a timely fashion. Barrios has never accounted for our homeowners fees with written statements. I was never informed about the "change in ownership" of the project, nor of the formation of the homeowners' association, things a reputable developer would do.

I am a US citizen and have owned at PSR for over 10 years, paying my taxes yearly (via a different attorney) and my property assessments yearly until this year, when Barrios' fraud came to light.
Barrios insists there is a legal HOA, but no property owners have ever been formally informed of its existence in writing, alerted to meetings or been asked to vote on issues facing our development. Unscrupulous behavior like this, if allowed to flourish, will set back Nicaragua's goals of enhancing international tourism, trade and expatriate communities.
I support this grievance 100%.
