REPRESENTATION FOR RESUMPTION OF PHYSICAL FUNCTIONING OF DELHI HIGH COURT

Virus shall remain for more than 6 months. Thus it is high time that Government , specially the Court may resume normal functions and even give direction to the Government to open up all including Schools , colleges, sports, Gyms, etc.

Video conferencing hearing is not an effective substitute for physical functioning of court's

We are educated and well informed now to start physical appearances.

I feel that time has come to open the District Courts physically provided that we all advocates being the officer of courts will ensure that we will follow all the guidelines of Govt. India and Delhi High Court with regard to Covid-19. At the same time it is our responsibility being the citizen of India to make all endeavours to keep our society safe and protected. I am also of the view that we should adopt the change in our legal system by using the video conferencing technology or other ongoing technology to compete in the legal world. I believe change happens when you desire it.

On reopening, mood And effort of Bench & Bar should be to Resolve issues/ disputes and also, disposal of matters. The crisis surely has given enough indication that There is nothing greater than peace, honesty, compassion, care and love. Live life to love it and love life to live it.

Along with physical functioning of the courts The lawyers chambers be also opened on a daily basis with restrictions so that offices functioning therefrom be made operational

Yes we have to settle in for a module where we can work and be of help and be safe and keep public from Corona .

As it has been decided not to use central air conditioning, the following suggestions can be considered: 1. In the criminal block on GF & FF the lobby windows can be opened and 08 court rooms can be used. 2. In the Old Block on the GF 06 court rooms can be made operational with the opening of lobby doors. 3. In the New Block on 2 floors where lobby doors can be opened in the balconies, 08 court rooms can be used. 4. With 22 rooms available and by using alternate court rooms, 11 court rooms can be used at one time. 5. Thus the HC can function with staggered timing by using 11 Court Rooms from 10 am to 1 PM and after cleaning of common areas the other set of court rooms from 2pm to 5pm. 6. The criminal courts and writ courts at one time can function and other courts including original side thereafter. 7. In this manner all courts can at least work for 3 hours per day and have good disposal of cases. This system can be used with other suggestions including all social distancing norms & restrictive entry guidelines. Regards

Combination of virtual hearings and physical hearing in case bench wishes to have, is the need of the hour.

We can start with physical hearings for urgent criminal/bail/stay/injunction matters for the time being.

The resumption of physical working needs to begin with safety measures and precautions. We need to live with precautionary measures instead of shutting the physical working of system. I think by digital working with glitches and network limitations, doors should not be shut for poor people. We need to look how many lawyers appointed or part of Legal Aid effectively rendered their services to poor needy people. So instead of shutting doors ..doors need to open with precautionary measures like Delhi High Court did in past. I may also point out that despite bomb blast in past doors were not shut but with strict checking and frisking work kept on continuing. We can in same way move ahead with more precautionary measure by taking Bar into confidence and by displaying guidelines. Lastly, I will borrow lines .. “show must go on”, subject to precautionary measures.

Simultaneously we should support the early opening of all district courts also which are responsible for more than 80 percent judicial work.

Its important to embrace video conferencing and minimize Court appearances. The court buildings should be better ventilated by opening the glass panes, use of water coolers and individual aircons in court rooms. Work has to go on!!!
