We, the undersigned, hereby petition members of the Planning & Zoning Commission and the Town Council of Milton, DE to deny the request made by developer Phoenix RHCS Holdings to rezone 8 acres, in downtown Milton across from H.O. Brittingham Elementary School, from R-1 Residential to C-1 Commercial.


A developer has proposed building an 80,000 sq. ft. suburban-style office park with approximately 425 parking spaces in the historic, residential community of Milton, DE. This proposal will require that an 8-acre, undeveloped parcel be rezoned from single-family housing (R-1) to commercial use (C-1). The property is located squarely within the historic residential district of this southern Delaware river town. The road leading to the property is 2 lanes wide, yet an estimated 3,100 vehicle trips per day would be generated. Furthermore. the new elementary school is directly across the street from the site.

Proponents argue that good-paying jobs, taxes and fees will flow from this project and benefit the town. But those same jobs, same taxes and same fees would (and should) be realized if the project instead was built on any of the vacant properties in Milton that are already zoned for commercial use. Those properties are sensibly located on roads more appropriate to the traffic loads and environmental impacts.

I live in the historic district and abide by the many 'rules' to keep the integrity of our beautiful town center. Re-zoning to commercial use should not be allowed, we already have designated areas for commercial use to build a medical office park.

Increased traffic near the Milton school is a danger to the students and families who walk on Willow Street and Mulberry Street. Project not congruent with the residential neighborhood. There is plenty of land on Rt.16 that can be utilized for a major project like is being proposed.

I will be retiring in Milton soon. I care about keeping the historic integrity of the town and feel that such development should be restricted to areas already zoned for such purposes. Otherwise, what is the purpose of zoning plans?

These kinds of spot rezoning are not in the long term interest of the town. I'm not against a medical facility or even a medical center in Milton, just not a rezone of a prime residential area. There is plenty of possibilities, both on RT 5 and Rt 16 for a great medical center.

Good idea, but not in-town. The idea that milton residents )many retirees), could walk or bike to an in town medical facility is silly. Also, way too close to a school.

My spouse works at Brittingham elementary and we are both very concerned about the increase of traffic around the school if this goes into effect. We strongly oppose the location!

I would consider moving if this were to happen. My family bikes and rides scooters along these sidewalks and roads and we could no longer do that. Preserving a historic location is of utmost importance and we should respect history and uphold the dignity of our town. There are enough towns and enough land owners that have “sold out” in sussex county and we have all seen the toll it has taken on our infrastructure. Let’s not aid the ruin of our beautiful, safe, downtown area.

Phoenix RHCS Holdings is based out of PA and has no business developing on Milton, DE land. We live directly across the street from the property in question and have kids that will be walking to school when summer is over and bike around town to friends’ houses on a daily basis. We strongly believe that the safety of kids biking/ walking and integrity of the town will be compromised if this passes. Please keep the people of Milton and the best interest of the town at the forefront of this decision. It will be noisy, disruptive, and does not fit the historic charm of the town. We strongly say ‘no’ to rezoning for this medical park.
