Teachers and/or spouses who are NOT physicians cannot diagnose & recommend institutionalization on an involuntary level. Only a licensed health care practitioner who has performed a complete patient history, physical examination and has in fact researched all other possible options first to treat the patient excluding the Baker Act.
Act as an immediate involuntary institutionalizations. It’s a ludicrous act altogether and should have never been brought into human society . Adults who have not been proven to be a danger for society should never be removed from their freedom.

recommendation of such testing should come from a license healthcare professional in the field of child psychology or psychiatry. Teachers need to stop diagnosing student this is out of their scope of licensing and stick to education.

Every effort should be made to contact the parent and let them and their doctor decide the best course for their child.

Parental rights are violated, not to mention those of the child, in the current scenario. Praying this gets changed!

Our 12 year old was Baker Acted and held for 3 days illegally. Thank you to CCHR for all their support and aid in having our child returned to her home safely. KM

My friends son was baker acted because a school was not trained in how to deal with a child who has issues. Would it have been so hard to have contacted the parents instead of making an entire family suffer for a weekend.

My son was just Baker Acted by the middle school resource officer this past Friday. He was released from the mental center that had his and the psychiatrist told us that our son should have never been Baker Acted in the first place. We, his parents, had no say in any of what occurred and could only see our son for one hour each day and talk to him on the phone for 10 minutes per day. We don't know how our son has been affected by what happened at this point. He is on the autism spectrum and does not easily express his worries and feelings. Only time will tell.
