Schools do not know the children like their parents do. Its unfair of them to have such power over someone elses child. And it has led to abuse of such power.

The baker act has been used against me twice in the past six months at the urging of my soon to be ex wife's atty (both times I was released after it was determined I was no harm to myself or others. Horrible experience !!!!

I believe it is important to take action on this matter where people with mental issues are involved. I believe this people including myself carry on a stigma whether the mental related issued was fair or unfair. Thank you for speaking up for this people.

I am in total agreement that a childs parents or legal guardian should be contacted first at all times before a child is Baker Acted. Also if it is not in a childs school medical records of a history of mental or behavioral illness no school employee has the right or permission to diagnose that child. Therefore Baker acting a child should not be the first option or ever a consideration to deal with that child especially without the parents consent or knowledge.

If the school personnel authorized to initiate an involuntary examination, called a Baker Act, truly believe that the behavior of a child is a result of mental illness then in our opinion, and according to the criteria for initiation, the parent or legal guardian should be contacted for the purpose of obtaining consent for a voluntary examination. This opinion is based on the existing law which you can read about more on our website at “Involuntary Examination of Minors”.
This is NOT being done. Instead involuntary examinations are being initiated on children without parental knowledge. The parent finds out AFTER their child has been Baker Acted.
Just in Florida there were 32,475 children sent for involuntary psychiatric examination during fiscal year 2015-2016.
This violation of human rights is happening to children as young as six years of age who are being Baker Acted without parental knowledge. A BuzzFeed investigative news report titled “HOW A 6-YEAR-OLD GOT LOCKED ON A PSYCH WARD” illustrates the abusive use of the Baker Act and the undermining of parental rights in Florida.
