What in the world is wrong with this picture! If I hit someone walking down the rd I am going to jail or prison. If I hit someone in a car, truck or suv I get a ticket for not having my vechile under control plus jail or prison time if I just someone. Who knows who I. This case because nobody else would just walk away. The whole helmet thing is part of a law where you have a choice to wear one or not. If that was the defense then it should be a law to wear one again. How many time do you hear watch out for Motorcyles because we have loved one that we want to stay safe and come home to us. Appt! Now someone is not coming home to their family and it is not their fault at all. Somebody else did something stupid. Come on people this is a no brainer here. Wake up!!

The driver of the car is the one that caused this man's death and should br held accountable on some level here. HE was NOT in control of his vehicle. Not too mention he had been driving into the sun for easily a couple miles and had no issue obviously with Not being able to see in front of him then! Or he was riding his ass so close he didnt notice the bike slower speeds?? Also, cars are built with this really neat contraption, that's specifically for Blocking the sun called a visor!!
Whether or not the motorcyclist had his helmet on is irrelevant. He would be alive today had he not been rear ended.

The driver of this car is responsible and needs to be charged! Saying it's the motorcyclists fault for not wearing a helmet is total crap. That's like justifying shooting someone & not pressing charges because the victim wasn't wearing a bullet proof vest.

If a child had ran out in front of him, and wasn't wearing a helmet, would the driver be charged? If he couldn't see a motorcycle with 2 large flags waving in the wind, how would he have ever seen a child? Waiting to find out the name and connection the driver of the SUV has with the Prosecutor.

The driver was not on control of his vehicle which places the driver at fault. I know for a fact if a driver loses control of their vehicle during inclimate weather, they are ticketed! This is no different and a life was lost! This judge needs to review the law!

The driver should have been able to visually see the distance between the SUV and motorcycle was closing. The SUV should have been at a safe enough distance away in order to stop in time as to not rear end th motorcycle.

I am appalled at the fact that this poor man appears to be the one at fault. Why was his law abiding decision to not wear a helmet even an issue in deciding whether or not to charge the irresponsible driver? Would a helmet have made him easier to see? No! It is a moot point and should have no bearing as to why the driver should not be charged. At what point do we hold people accountable? It's a slap in the face to the victim, his family and to motorcyclists. What a shame to think that even those who obey the laws are at fault ....even when it results in their own death. RIP Terry and may God be with you and your family.

This is inexcusable! A good man was killed. I have seen him ride with his flags and you can see him from afar. I drove home from work that night at the same time and I didn't kill anybody. This action by the prosecutor reeks of poor judgement.
