This whole situation is simply ridiculous! Stop prosecuting an innocent man! Had you found ANYTHING once you had him in custody, FINE! But he clearly had NO plans to harm anyone!!

humor and/or a lack of political correctness should not be a criminal charge. A careless word cannot represent the man as a whole.

The young man should face consequences for his actions. But prison is not appropriate. After making the statements and apologizing for the same, he went to Taco Bell and then to work. Give him Community Service (on top of what he already does). Have him work with Southern's Media department ot produce Public Service Announcements. Prison time for this offense is ludicrous!

This is a story of three mistakes. 1.) Mr. Gains made a mistake with a flippant comment that he recognized was inappropriate. 2.) The office worker at Chattanooga State made the mistake of overreacting to the statement. 3.) The Hamilton County sheriff department has pursued Mr. Gains, in the face of the FBI recognizing the circumstances and dropping their concerns. I think it is time for the comedy of errors to come to an end.

You obviously don't know Jimmy or the law. Did you know that spitting on Nashville sidewalks is illegal? So if you are a tourist and a fly flew into your mouth, should the prosecutors throw the book at you for spitting it out? Be reasonable.

By the way, have you actually read the particular law he is charged with?

If any of us had to face prison for mispoken words, we would all be in jail. This was a frustrated jest and NOT a crime.

I would also like to add, how is this funny... (quote from Jimmy) "I have done all I can think to do except put a gun to their head." and "I guess I will go back to Southern and try to pick up my transcript and strap a bomb on me." How are those comments funny? If I saw something like the second quote, I would be on the phone with 911 before you could type "jk."

Have you ever said "terrorist" or "bomb" or "gun" in public or even on social networks before? Chances are you have. We should throw the book at you and have you spend 3+yrs + felony for such atrocities! \s So as a country, we are getting to the point of suspending 8 year old kids for just making a hand gesture that looks kinda like a gun. Welcome to your "political correct" & tattletale society. I believe that things mostly, with a few exceptions, played out like they should have up until this case hit the prosecutors desk. 3+yrs + felony seems unreasonable to me.
