Whereas Mr. Saul Itzhayek, a Canadian citizen, has been unjustly incarcerated in Motihari Prison in Motihari City, Bihar, India; Whereas Mr. Itzhayek, was lured into India and guaranteed safe passage by police authorities despite the fact that Mr. Itzhayek had informed the police that the Indian visa he possessed had already expired; Whereas, in a clear case of entrapment, when Mr. Itzhayek entered India on May 29, 2007, he was arrested and on October 11, 2007 sentenced to three years in prison under Article 14 of the Foreigners Act of India for entering India on an expired visa, a punishment grossly disproportionate to the alleged offence; Whereas Saul Itzhayek has lost 30 kilos since his incarceration and is being detained in deplorable conditions; Whereas the Canadian people expect our government to do everything possible to help Canadian citizens who are wrongly imprisoned; And more specifically to escalate any matter with the Indian Government that would be necessary to encourage them to expedite the release of Saul Itzhayek; We the families, supporters, community groups, clergy, parliamentarians, concerned citizens and friends alike urge the Canadian government and more specifically Prime Minister Stephen Harper to make every possible effort, at the highest level and without further delay, to secure the release of Canadian citizen and Montreal resident, Mr. Saul Itzhayek, from prison in India, and to urge the Indian Government to use what executive order it wishes to do so;
