This petition is regarding the below cases:

16-CR-007627A | The People of the State of California vs. DILLIE, ERIC

16-CR-007627B | The People of the State of California vs. VAN WEY, BROCK

16-CR-007627C | The People of the State of California vs. TAYLOR, RANDY

These cases, important in Livermore, and more broadly for the safety of children in Alameda County, address child abuse as well as the alleged failure of individuals mandated to report after an alleged occurrence of child abuse.

If you do nothing, say nothing, the Alameda County District Attorney, Stacie Pettigrew stacie.pettigrew@acgov.org, may simply decide to drop charges against the responsible individuals due to "lack of community concern".

"LACK OF COMMUNITY CONCERN?"

That could set the pace for other such cases to not even be brought forward. Would you want your child's safety to be put in jeopardy? If you do nothing, say nothing, do you want to send a message to administrators and others responsible for the care your child that they can decide what should or should not be reported?

MANDATED REPORTERS HAVE OBLIGATIONS UNDER THE LAW

A list of persons whose profession qualifies them as “mandated reporters” of child abuse or neglect is found in California Penal Code Section 11165.7. Amongst many others, it includes all school/district employees, administrators, and athletic coaches.

All persons who are mandated reporters are required, by law, to report all known or suspected cases of child abuse or neglect. It is not the job of the mandated reporter to determine whether the allegations are valid.

WE MUST ACT QUICKLY

If our voices are not heard by the time of the court case on Monday June 12, 2017 the Alameda County District Attorney may drop charges against 3 individuals involved in an alleged incident in 2016. Charges were filed, witnesses and other evidence exist, yet they may evade accountability without even a trial.

If the individuals are innocent, the justice system should acquit them. However, if the case never makes it to trial because it is dropped due to "lack of community concern", the safety of children could be put at risk in the future. The Alameda County District Attorney's office is tasked with the job to prosecute when a crime has been committed, whether or not the community is paying attention.

If you feel this court case should be heard in trial and not dropped, please speak up now.

The undersigned are asking the Alameda County District Attorney to see this process through rather than drop charges. This community is very interested and concerned. We are paying close attention to this case.
