16-CR-007627B | The People of the State of California vs. VAN WEY, BROCK
16-CR-007627C | The People of the State of California vs. TAYLOR, RANDY
These cases, important in Livermore, and more broadly for the safety of children in Alameda County, address child abuse as well as the alleged failure of individuals mandated to report after an alleged occurrence of child abuse.
If you do nothing, say nothing, the Alameda County District Attorney, Stacie Pettigrew [email protected], may simply decide to drop charges against the responsible individuals due to "lack of community concern".
"LACK OF COMMUNITY CONCERN?"
That could set the pace for other such cases to not even be brought forward. Would you want your child's safety to be put in jeopardy? If you do nothing, say nothing, do you want to send a message to administrators and others responsible for the care your child that they can decide what should or should not be reported?
MANDATED REPORTERS HAVE OBLIGATIONS UNDER THE LAW

A list of persons whose profession qualifies them as “mandated reporters” of child abuse or neglect is found in California Penal Code Section 11165.7. Amongst many others, it includes all school/district employees, administrators, and athletic coaches.
All persons who are mandated reporters are required, by law, to report all known or suspected cases of child abuse or neglect. It is not the job of the mandated reporter to determine whether the allegations are valid.
WE MUST ACT QUICKLY
If our voices are not heard by the time of the court case on Monday June 12, 2017 the Alameda County District Attorney may drop charges against 3 individuals involved in an alleged incident in 2016. Charges were filed, witnesses and other evidence exist, yet they may evade accountability without even a trial.
If the individuals are innocent, the justice system should acquit them. However, if the case never makes it to trial because it is dropped due to "lack of community concern", the safety of children could be put at risk in the future. The Alameda County District Attorney's office is tasked with the job to prosecute when a crime has been committed, whether or not the community is paying attention.
If you feel this court case should be heard in trial and not dropped, please speak up now.
The undersigned are asking the Alameda County District Attorney to see this process through rather than drop charges. This community is very interested and concerned. We are paying close attention to this case.

I was looking at the screen and just realized how many people actually care about these cases and it honestly makes me feel a bit less hopeless about the whole situation. It feels like we are finally showing the district attorney that we are watching everything they do.

Wrong is wrong, regardless of perceived community interest - this is especially true in cases involving children, and mandatory reporting.
I hope the prosecutor will change her mind. I do not feel that "community concern" should be a metric by which she determines whether ANY case should be prosecuted. Rather, shouldn't the "prosecution worthiness" of a case be evaluated on the merits of the evidence?! All that said, yes, I am very concerned about this case. Mandated reporter laws were developed by responsible adults to ensure that irresponsible adults are kept away from our kids. If you have evidence, then you have an obligation to do what is right.
Our society is based on sets of rules and order. It is frustrating, to say the least, that people in positions of power are not held to the same standards as the regular Joes. People need to know they they will be held to account for their actions, and in this case, their inaction to protect our most vulnerable, the children within our community. The arrogance shown by these individuals, shows just what is wrong in our society. That those with stature and means are allowed to escape. This only emboldens them to believe they are above the law. Case in point, Mr. Dillie, has been allowed continued contact with children despite his arrest on failure to report child abuse.
These individuals victimized a student under their care. They should not benefit because he isn't currently residing in the United States.
As a mandated reporter for all of my professional career working in social service, healthcare and the Dept. of Rehabilitation. Dropping this case is not acceptable and sets a dangerous precedent.

Not following through with this case is the same as turning a blind eye to child abuse. Follow through to the fullest extent so that those who should have known better... those who are supposed figures of authority... those who need to be held accountable grasp that we will not stand up for, or allow the mistreatment of our children!
