Backcountry is a generic enough term that it should be free for all. I have no issue with trademarking their .com, logo, or even their slogan goatworthy.
Leave Backcountry alone though.

I stand with the community and small businesses. The optics of the entire situation are horrible. In this case, the optics *are* the situation to your customers, because you haven't been able to explain anything, citing the NDAs you yourself wrote and signed. We see a large company going after only small businesses that don't have the resources (time or money) to fight anything. We don't see any litigation or large companies or agreements between large companies, if that's what happened. I've spent thousands at Backcountry.com and it's subsidiaries, but right now, I don't see myself ever buying again. You may earn my trust back, but it will take a lot of effort and the apology that was released was a step backwards, in my opinion.

TSG Partners knew and know full well what they were doing. This was not a “fumble”. They were never concerned about small businesses or what was morally and ethically correct. It was and is about business and controlling the market.
What they did not anticipate was the tremendous backlash from the community and a concentrated response that most definitely effected their bottom line. It is clearly essential that trademark law must be modified so that this form of corporate tactics is forbidden.

I wholeheartedly support the contents of this letter, and pledge to not purchase anything from backcountry.com, or any other TSG-owned brand, until a solution is found that protects all the small businesses out there that have been threatened, are currently being threatened, or could in the future be threatened, by the aggressive trademark-protection actions in which backcountry.com has engaged.

You can’t bully this community and it’s businesses without it biting back. Just like when we head into the mountains when you think you’re king of the hill you get slapped back into reality. Some people die because of being complacent in the BACKCOUNTRY. It may cost you your business.
