This Petition comes from the Residence of Decatur Township

We are requesting denial to rezone the property at 5745 Kentucky Avenue, see case number 2018-ZON-120 from the D-A district to the C-4 Classification.

Key reasons for the request for denial are as follows.

We believe that impact to the surrounding residential area to be detrimental to the community health. The homes surrounding the property being discussed are all on septic systems and most on well water. To allow for a gas station with its underground tanks and the asphalt lot would cause significant problems to water drainage and therefore allow for the health and environment of the community to be compromised.

There are concerns to the proximity of gas and diesel fuels and leakage potential to the wells that supply water to the surrounding homes.

To allow the re-zoning would allow multiple violations to the Indianapolis Indiana Noise Ordinance ARTICLE III. NOISE Sec. 391-301. The residences feel that the proposed re-zoning would disrupt the tranquility of the neighborhood.

We have concerns on the impact and safety of the local traffic. Some of these are based on prior traffic Reports and concerns previously documented in the Maple Ridge Estate streets. We feel that the traffic report done by Casey’s Marketing has not been extensive enough to include the Maple Ridge Estates known traffic concerns, nor the impact of a similar traffic scenario just 2 miles away on Kentucky Avenue since the installation of the Circle K gas station and the significant increase in accidents at that intersection.

We feel that granting the variance will alter the essential character, and the tranquility of the neighborhood. The scale of the proposed project is extensive, and we feel negatively effects the changes in the noise, odor, and visual intrusions upon the peace and privacy of the residence.

Please do not allow the variance. There is plenty of other commercial real estate in the area that is already zoned for a gas station that does not pose the same concerns because they are not right against residential property.

We don’t need more gas stations in Decatur. We need roads resurfaced and increased in size to handle the influx of people we have had the last several years. The number of semis traveling ok KY Ave these days has become quite a problem. Adding more congestion to an already over used, undersized stretched of highway is not acceptable.

We have enough gas stations on 67 we do not need another one . The congestion on highway 67 has become a nightmare we do not need anymore businesses along this stretch of our township .
