Bylaw Amendment Petition

This petition is to add the following amendment to The Club at Castlewood Bylaws per Section 17.1 of the Club at Castlewood Bylaws:

"No changes shall be made nor implemented, in the operations and governance of The Club at Castlewood, by the board, management, staff or contractors, that eliminates, reduces, diminishes, or encroaches on the rights, privilege's, and enjoyment of the golf course access afforded to the Primary Regular Member(s) of The Club at Castlewood, until such time the changes and implementation have been approved by a majority vote from the Primary Regular Membership via an Official Ballot."

The necessity for this petition arises from the recent 10/17/23 Golf Policy Update that was initiated without Official Regular Member vote either by Ballot or Special Meeting, which resulted in the filing of a 98-member signed petition on 10/25/23 requesting that the matter be resolved through an Official Club vote.

A disagreement exists between (1) the signers of the petition and (2) those who approved the Golf Committee’s recommended Golf Policy Change due to their intention to enact such change without an Official Regular Member vote.

The purpose of this proposed bylaw amendment is to remove any ambiguity surrounding the implementation of potential golf course access changes that impact the existing rights and privileges of the Primary Regular Member(s) without an Official Membership vote.

This petition takes no position to any potential course access changes, only that revisions affecting the Primary Regular Member(s) be vetted through an Official Regular Member vote.

  1. CCCBylaws.12.1.8.22 Section 17.1 Amendments to Bylaws (4) - By a majority of the Regular Members voting at a special meeting or by ballot, pursuant to a petition of twenty percent (20%) or more of the Regular Members in Good Standing addressed to the Board of Directors.
  2. 527 Regular Members as shown in 11/16/23 Solar Project Ballot Certification. 20% = 106 signatures needed.
