I personally have gone to HR to question why I am not being paid OT for hours worked I live in a state were my position doesn't not meet exemption requirements regardless of what the Company may say, I also signed a form when I was first hired stating I am eligible for OT however what concerns me is if I try to put more than 40 hours my time card is rejected. I work on average close to 50 hours a week. I' m often working on my vacation days/ days off ...That's stealing

You can spout all you want about legalities and how its great. No one gets paid what they deserve. This is true. Everyone will ALWAYS want more money for the average person. However, I like having a job as well. To me, it is not a fear of LG leaving, it is an inevitability. Look at it this way. Lets say LG needs to have something done on the spur of a moment with a turn around time of 48 hours because of a critical issue. Now it will need to go through the Union. Time lost while they debate if it is ok. Eventually what LG will say is they will leave the contract. What saves us now is that their is a HUGE launch and they cant afford to leave. Now, if you want to talk about overtime, you can also quote that our work agreements also talk about the fact that we are salaried to accomplish tasks. There have been times people did less than 40 hours of work and got paid for 40 hours. Unfortunately there are times it is over 40 hours without overtime pay. So now what would happen is we would need to go hourly. So how would we clock in and what would count as on clock? Most likely just time in store, but that is solely my opinion. But regardless, now everything will need to be accounted for, time in store, travel time, report time, etc. So everything will be very closely monitored. So if you reported you were in a store for 60 min but only monitored 59, guess what you are falsifying company records.
I am not saying this is a bad thing at all. Change definitely does need to be made and I am fed up as well. However, you really need to think of the bigger picture rather than rallying troops during a troubling time. Play the "what if" game. Think of what you would want changed, how you think it would be changed, and what repercussions will happen.
At the end of the day, if I was LG, I would leave the contract too. There could be lawsuits all day long, but LG could easily prove that it isnt because of the Union, but because of missed goals and needs from them at this poin

In an attempt to answer an email from someone concerned about the contract being dropped I attempted to respond. Sadly it appears the email address [email protected] has been blocked because nearly every email address failed to send.
For that reason I've posted my email reply below.
1. I know for a fact that management has already been notified of this petition by someone and they think it's funny. This tells me one simple fact. THEY DO NOT CARE ABOUT US! They don't care if you work over 40 hours and don't make overtime, they don't care that you are paid lower than peers in the rep industry, they don't care if the duties and goals constitute working more than 8 hours per day. Simply put if they think this petition is funny, they don't care.about you.
2. There are several people within LG who feel sad for us considering the pay scale. They know Marketstar doesn't pay people what they are worth.
3. LG has no reason to drop the contract because we desire union representation. LG does not employ us, Create employs us. Nothing is negotiated with LG. In my personal and professional experience there are several major companies across the planet who use contract companies much like Create/Marketstar and it's employees are unionized. Companies such as Lockheed Martin, Intel, Verizon, AT&T, Honeywell, Comcast, Sprint, Intel, General Dynamics, and Time Warner Cable have and continue to use a contract company or companies which have unionized employees.

Hiding behind a fake name? Kind of like the pot calling the kettle black isn't it? Unless your real name is El Gee, but I highly doubt it.
I've chosen to "hide" behind my real name because I don't want tons of phones calls and emails asking questions. Trust me, eventually you will learn my identity.
A majority of people who've signed the petition signed it with their true names which can only be seen by me. So far only one person has started a discussion topic with their real name.
Why would the client care if we are union? You must not know there are quite a few LG employees who feel the conditions and pay are deplorable, which leads me to believe either one of the below
1. You are fairly new to the team (6 months - 1.5 years)
2. You are not a Product Specialist, Trainer, NRBA, nor BA.
LG as our client would have no reason to drop Create/Marketstar just because it's employees desire union representation. There are several companies in the United States like Marketstar/Create which have unionized teams working on contract for client companies. In my experience here are the ones I've personally have had experience with such as Lockheed Martin, General Dynamics, Intel, Microsoft, AT&T, Verizon, Comcast, Sprint, and Time Warner Cable.
LG doesn't employ us, they do not have a voice in this, and for that matter neither does MarketStar. Please educate yourself on the NLRB (National Labor Relations Board) and the National Labor Relations Act started by Congress in the 1930s. I posted a discussion on this earlier today, if you read it it may calm some of your fears.
As far as taking the lower pay than industry standard, no overtime over 40 hours, and work duties that require more than a 8 hour day to Lance and Anthony, you evidently haven't tried this yourself.
Many people who've signed this petition have heard the phrase "If you don't like it, you can quit".

I've been hearing that some people are afraid of what might happen if we decide to unionize. That is an understandable concern but based on F.E.A.R. (False Evidence Appearing Real). To those who are unhappy with the current status quo while yet not doing anything to make the situation better, you have no right to complain about the current work situations and pay. And most of all you should be happy and pleased to hear what many of us have been told when we speak our opinions to management, "If you aren't happy, you can quit".
If you are unhappy about the current work conditions and you decide to not sign this petition, what will you do, nothing?
