BSX LVL refund request

These are the terms of use rules straight from Kickstarter, how many of them did BSX NOT break? When a project is successfully funded, the creator must complete the project and fulfill each reward. Once a creator has done so, they’ve satisfied their obligation to their backers. Throughout the process, creators owe their backers a high standard of effort, honest communication, and a dedication to bringing the project to life. At the same time, backers must understand that when they back a project, they’re helping to create something new — not ordering something that already exists. There may be changes or delays, and there’s a chance something could happen that prevents the creator from being able to finish the project as promised. If a creator is unable to complete their project and fulfill rewards, they’ve failed to live up to the basic obligations of this agreement. To right this, they must make every reasonable effort to find another way of bringing the project to the best possible conclusion for backers. A creator in this position has only remedied the situation and met their obligations to backers if: they post an update that explains what work has been done, how funds were used, and what prevents them from finishing the project as planned; they work diligently and in good faith to bring the project to the best possible conclusion in a timeframe that’s communicated to backers; they’re able to demonstrate that they’ve used funds appropriately and made every reasonable effort to complete the project as promised; they’ve been honest, and have made no material misrepresentations in their communication to backers; and they offer to return any remaining funds to backers who have not received their reward (in proportion to the amounts pledged), or else explain how those funds will be used to complete the project in some alternate form. All. I’ve been removed from the backer list on Kickstarter. I’m guessing it has to do with the second credit card appeal...?

I don't believe this product will be delivered, so far none of the timelines are met. And it keeps moving out.

I would like to voice my support to the refund request. I am lucky that AMEX processed my refund request against BSX/Kickstarter and now they kick me out of the backer list and I cannot post on the LVL kickstarter comment anymore. Please someone help me to relay my message to the backers that Credit card company charge back can work. Please try.

They told they had a working lvl but after I think 3 months of delay they told us that it wasn’t working. A delay of a year is to much they have work harder!

Reviewing the information on the Kickstarter Campaign page for LVL, in contrast with the status of this project is now (more than a year later) - there is no doubt that was obvious misinformation and fraud from the get-go. BXS Athletics/LVL has purposely mislead over 7500 Kickstarter Backers and taken $1.2M of their money.

BSX showed, in the most positive feedback I can give to the company, no respect at all to the backers. Kickstarter first promotes the campaign (as a Project we love) and then after getting 55K fee does nothing at all. Refund!
