Another justification is to regulate number of ounces of refills, but this could be done via reasonably accurate proxy methods, like placing a masking tape line next to the register of the maximum acceptable cup height. It wouldn't be exact, but it would be close enough to protect whatever interest Harry's has in regulating mug size without being so self-serving.
