Berkshire Condominium Association Petition to the Dupage Zoning Board of Appeals

We definitely support this!

I share the concerns raised by the other individuals who have commented on this petition. The expense of maintaining the streets in Berkshire is borne entirely by homeowners in our association. Property owners in the proposed development will undoubtedly use our streets, increasing wear and tear and maintenance costs. Yet they will not contribute to the cost of upkeep. Not only that, but with the proposed development being part of Lombard, the property owners in the proposed development won't even contribute to the same municipality that we in Berkshire are taxed by. These issues must be addressed as a matter of fairness.

We have many concerns about the proposed development. Many have been mentioned by the other homeowners. Our concerns: -The access road that would be directly behind our property. There would be a lot of cars entering and exiting on the access road with noise, fumes, ect causing disruption to the homeowners who live on the south side of Oxford. The access road is way to close to our fences. -Concern about the impact on our streets.The increased traffic and wear and tear on our streets. Will the new homeowners have access to our streets. If so,will they be paying for the maintenance, upkeep and snow removal? -Drainage and run off from the development. Our property is three to four feet below that lot with a retention wall. We are extremely concerned that there is a possibility our basement may flood. -Concern about our property value being jeopardized. Linda and Marty Cochrane 1117 Oxford Ct.

I’m confused why the address for the adjacent property is listed as Lombard. Was it annexed by Lombard, and if so, when? I chose this property because of the private back outdoor space. This plan not only takes the privacy away, but it includes a road directly behind me. This road is unnecessary when there is an already established street on the other side. The property should be made into cultivated open green space to be enjoyed by the entire community.

As a home owner in Berkshire, I see no positive value in this development on our small and quiet community. I feel the property values, and the environment will be negatively affected by this development. I echo the thoughts and comments expressed by others signing this petition. Frank E Davis

I have many concerns which have all been stated by other home owners. I am especially worried about our streets which WE pay for? These are narrow streets with very low curbs. All the homes on the West side of Luther are part of Oakbrook Terrace, (from the Park Dist. going South), including the 1 new home recently built across from the Park Dist. Why are these 10 new homes not a part of Oakbrook Terrace? Can the front of these homes face Essex and their street address be Luther? Are these 10 homes going to contribute to the many expenses we pay for especially snow removal & street repair. This is wrong.

I am concerned of the use of our streets to gain access to the development. The wear and tear will be at our expense. Unless we put a key-card at every street belonging to the Berkshire, we know the new residents will use OUR streets! The increased traffic is also a concern as the safety of our little complex will be compromised. If my vote counts, I vote definitely NO to this proposal.

1. The grade and elevation of the proposed development is higher than the houses on Oxford Ct. Strong concern about the environment, drainage, and run off. 2. Too many houses in a small land footprint. 3. The negative affects of price values of present homes. 4. The affects of this construction on the environment, dust, (air quality for open windows) accumulation of dust on our houses, inside and out) and our yards and patios. Constant noise and dust. 5. Deterioration of our streets during construction. 6. Use of our associations streets my new tenants that pay no fees. 7. Our costs will go up our property values down. 8. How do they plan to access and connect their utilities as well as sewer and drainage. 9. What is the price range of proposed houses. 10. What is their plan to pay the association for the wear and tear on our streets and sidewalks.

we agree with the concerns already raised. Luther is already a very busy street due to the traffic generated by the Park District. This summer due to the Park district not having enough parking space, six to eight cars are parked on the street on the east side of Luther. The new development will only increase traffic, particularly during the construction phase. I don't see how the driveway in the new development, with only one entrance and exit , can handle 10 to 20 cars plus garbage trucks, delivery trucks etc.

1. My house is at the conner of Oxford Ct and Luther meaning that my back yard is right at the entrance of the proposed access road. all vehicles entering or leaving will create additional noise. My master bedroom will be a few feet from the access road. 2. About 20 months ago during a very heavy rain storm the water drain that sits right at the entrance of the proposed access road was at capacity and as a consequence of that my sump pump could not keep up resulting in an inch of water in my basement, my concern is that with 10 additional homes will the drain be capable of handling additional water runoff. 3. How will we control the traffic flow. Will we allow the new home owners access through the Berkshire streets or will they be required to access their homes through Luther. 4. The terrain behind my property is not level runoff water could damage homes that back up to the development. 5. My wife Barbara and I are long time homeowners in Berkshire and enjoy the tranquility behind our home, and we prefer to keep it the same. I am afraid that with the construction of 10 homes and the disruption it will cause will force a lot of our neighbors to sell, I know my wife and I have considered it. We are senior citizens that enjoy the peace and quite this neighborhood offers at this point in our lives. 1. !0 homes seems to be too many 2. The added traffic it will cause. 3. The access road is a terrible idea because the residents on Oxford will hear continuous garage doors operating along with the possibility of 20 cars moving in and out at different times. We would prefer a buffer zone with a tree lining behind our fence. The houses should have access to Essex with stipulations. 4. In the 21 years we have lived in Berkshire we have never had a flooding problem, so has there been a drainage and runoff study done. All the homes on Oxford are three to four feet below that lot with a retention wall. 5. As someone else mention, what police departments jurisdiction are we under, Oakbrook Terrace or Lombard? 6. How can garbage trucks negotiate that access road if that became the reality. 7. What is the realistic length of time for a major construction project like this. I am very concerned that the scope of the proposed development is too expansive for the size of the area. I believe the variances requested will result in decreased pedestrian and vehicular traffic safety and increased construction noise and danger.

As a long time resident (21 years) of this community i have many objections regarding this proposal. When viewing the lot I cannot envision the construction of 10 homes . The area is not accurate as drawn on the plans. The land sits well above ours and the risk of flooding is a real threat. There would be no barrier between our fence and the proposed access road directly behind it. Construction would severely impact Luther and all that live on Oxford Court. Being that we own our streets the only access would be Luther which would place a burden on residents a well as the children playing in the park. I have many more concerns that need to be addressed.

1. Ten homes appears to be too many for that size property. 2. Traffic will become a problem and who will pay for road repairs on Berkshire owned roads? Construction will have to use Essex at the very least. 3. The road for garage access will be directly behind the Oxford homes' fence. How will this affect noise levels and their property values? 4. What about water runoff? How will that be affected by new construction? 5. Currently, that land is home to wild animals. What is going to happen to those animals and will they end up in our yards? 6. Why are these homes in Lombard and not Oakbrook Terrace? How will these homes be policed? 7. Berkshire was designed in such a way that despite the homes being close to each other, we have privacy from our neighbors. These new homes look like they will break that carefully laid out plan. 8. The corner at Essex and Luther is already a bit of a dangerous corner. Increased traffic and new homes will only make this problem worse, unless proper signage and sightlines created. 9. Density much too high!!!

1. It appears that the exceptions requested are to accommodate more houses. 10 homes is too many for this property. 2. The proposed road would be within 12 inches of our back property line on Oxford. This would increase noise and light pollution from people pulling in and out of their driveways in the new development. 3. The property is not level. Water runoff could flood the homes that back up to the development on Oxford and could also create flooding on Luther. 4. The proposed road has no turnaround for large vehicles like firetrucks or garbage trucks if garbage is to be picked up on that side. Large vehicles would have to back up the entire road onto Luther, creating dangerous sight line issues on an already busy street. 5. Construction traffic and ongoing traffic would clog Luther and make it more dangerous around the park, which has a great deal of activity and many children. 6. The development will markedly increase traffic on Courtyard, Fairfax, Oxford, Luther and Essex. All but Luther are owned by Berkshire. The increase will cause additional wear and tear, costing our development considerable money to maintain. For the board: Is the fence line behind the homes on Oxford Ct. right on the property line, or is there clearance to the south of the fence that is still owned by Berkshire? Storm water runoff - where will it go Too minimal space between homes Streets in Berkshire are private - where will these residents park Many of the lots on Oxford are much lower than discussed lot. This could cause major drainage problems Construction traffic thru Berkshire will cause an abundance of disruption How will garbage collection and snow plowing be accomplished and where will snow go Requested corner variance seems unacceptable

This property being the focus of this variance request is directly across from mine. I so regret that I would be subjected to the noise, the dirt and the traffic generated by this project. Along with all of the other detriments involved. Please tell me that it is never going to happen!!

Will there be a landscaping screen between their road and the back of our homes? This lot is in unincorporated DuPage County. Therefore, there is no police response from Oak Brook Terrace. How are these homes protected and how long will it take for a response from the county police and the fire department? Nine of the proposed homes are only 2,050 square feet. What impact will that have on our home values?
