Homeowners deserve legislation that safeguards their rights and ensures transparency within Homeowner Associations. House Bill 361 as written falls short in providing necessary protections, instead favoring developers and builders.
We believe that the bill unfairly benefits the Developers and Builders at the expense of the homeowners and codifies into law what the developers have been wrongly forcing on homeowners without a law. Homeowners should not have to subsidize the developer’s investment risks, especially since they cannot share in any future profits. HOA governing documents serve as community “constitutions.” However, they are essentially one-sided contracts, written to benefit developers.
It is crucial to enact HOA laws that level the playing field through checks and balances, giving homeowners a voice in decision-making processes. By empowering homeowners to hold HOAs accountable, we can create a fairer environment that respects the interests of all parties involved.
We ask that you prioritize the well-being of HOA homeowners and promote fairness within community governance and veto this atrocious legislation.

The Bill was written ". . . . of the developers, by the developers, and for the developers." HOAs, which are mini-governments, must derive their powers from the consent of the governed. Please veto this Bill and appoint a representative task force to study the issues and develop a better, fairer, and more comprehensive system of HOA laws.
Builders and developers in the valley are already creating future ghettos with lowest quality materials and labor. It’s way past time to give them LESS leverage not more. DO NOT PASS OR ALLOW LAWS LIKE THIS!
Please veto HB 361. HOA control should be turned over to owners at 75% occupancy, not 95%. Thanks so very much.
Developers, regardless of risk they take developing a piece of property need to relinquish control at either 50% or 75% complete...NOT the proposed 95%!
Please veto HB 361. No input from homeowners in this bill. Keeps HOA dues in control of developers until project completion.

Please veto this bill. Each HOA is ultimately a pact we make with each other to promote what is best for our neighborhood. It is common knowledge that developers in Idaho use HOA CC&Rs to push through savings for them while leaving neighborhoods stuck with the bill and legal hassles that neighborhood HOAs must navigate in order to have equitable CC&Rs.
