I had a ZTE blade which is a 2010 phone and is getting really outdated and slow but it still had the latest OS because it had a Qualcomm chip. I bought a Xolo Q1000 which is a more recent phone and relativly faster than my previous one but quickly got disappointed when I found out the nature of MTK phones. In fact my Blade now has an Unofficial Cyanogenmod 11 (Android 4.4) update on XDA which really pisses me off because a >4 year old phone outdated phone I just bought. So I really recommend you releasing the code. It's for your own good anyway.

MediaTek, you're doing wrong. Become legal, become open. I'll never buy a MediaTek powered device, also i will never recommend a MediaTek powered device witohout open kernel source. Your are also in Conflict with GPLv2.

@MTK: remember that using the Linux kernel brings you free code but also some duties. The kernel (and many other softwares you rely on) are under the GPL license. You may of course keep your own internally-developed softwares under a proprietary license, but at lease all code derived from GPL license must be published (especially the linux kernel for all your SoCs). And your customers/ODMs must also be aware that they have to publish it too. Otherwise it is an illegal use of this code and a copyright violation.
