عريضة لمجلس الشورى بشان مساندة ونصرة فلسطين وقانون مقاطعةاسرائيل

انطلاقاً من عقيدتنا الراسخة، وحق المواطن العماني في المشاركة في الشؤون العامة بموجب النظام الاساسي للدولة، واستناداً الى حق مجلس عمان باقتراح مشروعات قوانين وإحالتها الى الحكومة للدراسة والموافقة،
وفي ظل العدوان الغاشم على الشعب الفلسطيني الأبي وبشكل خاص على غزة و الظروف الراهنة من استمرار تصعيد العنف والهجمات على الأطفال والأبرياء وارتكاب المجازر العلنية من قبل الكيان الصهيوني في حق الشعب الفلسطيني الشقيق والذي يعد انتهاكاً صريحاً للقانون الدولي والقرارات الأممية ومواثيق حقوق الانسان والأعراف وكل مبادئ الانسانية.

وعلى غرار الجهود الدولية الحثيثة في سبيل محاسبة ومحاكمة اسرائيل على هذه الانتهاكات المتكررة ومن ضمنها القضية التي رفعتها دولة جنوب افريقيا أمام محكمة العدل الدولية بتهمة ارتكاب اسرائيل جرائم إبادة جماعية في غزة، واعتزازنا الدائم بمواقف سلطنة عمان الخارجية المشرّفة والداعمة للمسجد الأقصى وللقضية الفلسطينية بقيادة مولانا حضرة صاحب الجلالة السلطان هيثم بن طارق المعظم – حفظه الله ورعاه- لاستعادة الفلسطينيين كافة حقوقهم المشروعة، فإننا:

نتقدم نحن شعب عمان الوفي الى مجلس الشورى المنتخب لاتخاذ الإجراءات اللازمة وبصورة عاجلة لتحقيق التضامن الفعلي والدعم الحقيقي للقضية الفلسطينية ونرجو من مجلس الشورى ممارسة كافة اختصاصاته وفق الأدوات المقررة له بموجب المواد 48 و57 و59 من قانون مجلس عمان وذلك لتحقيق الآتي

الالتزام بقانون مقاطعة اسرائيل (رقم 72/9)ومخاطبة الجهات المعنية لتضمين المقاطعة في اللوائح والعقود -1

نطالب المجلس بمخاطبة كافة الجهات المعنية بشكل فوري وذلك لتأكيد سيادة القانون واتخاذ الاجراءات اللازمة لتنفيذ قانون مقاطعة اسرائيل (رقم 9/72) ونتقدم بطلب تحديث جميع عقود وسياسات ولوائح المشتريات ولوائح الإستثمار الخاصة بحكومة سلطنة عمان والشركات المملوكة لها وذلك لضمان المقاطعة على جميع الاصعدة وتقييد أي تعاملات تجارية مع إسرائيل أو الكيانات والأفراد الإسرائيليين بشكل مباشر أو غير مباشر

2 - استكمال مقترح تعديل قانون مقاطعة اسرائيل

قام المجلس مشكوراً في فترته التاسعة وفي جلسته الاعتيادية لدور الانعقاد السنوي الرابع 2022 – 2023م بمناقشة مقترح تعديل قانون مقاطعة اسرائيل، حيث كان المقترح محدودا ولم يرى النور ، لذلك نطالبكم بإجراء مراجعة شاملة للقانون المشار إليه وتحديثه بما يلائم خطورة الوضع الراهن، ونقترح أن يشمل القانون مقاطعة كافة الجوانب بما فيها الجوانب التجارية والمالية والثقافية والرياضية والعسكرية والمدنية والسفر. وكذلك منع الطائرات الاسرائيلية من التحليق بالمجال الجوي العماني ودخول الإسرائيليين الى أراضي السلطنة حتى من خلال التأشيرة الخليجية الموحدة أو عن طريق ممارسات وأنشطة مركز الشرق الأوسط لأبحاث تحلية المياه وبأي شكل من الأشكال

3 - تقديم مقترح لتخصيص يوم في السنة في سلطنة عمان يسمى يوم فلسطين.

تقديم مقترح لتخصيص يوم في السنة تثبيتاً لموقف سلطنة عمان وتأكيداً على اهتمامها البالغ بالقضية الفلسطينية وتفعيل كل ما من شأنه أن يحقق نصرة الشعب الفلسطيني الشقيق وارساء السلام والعدالة من خلال إقامة دولة فلسطين وعاصمتها القدس

كلنا ثقة في أن ترى المقترحات أعلاه النور وفي وقت قياسي بإذن الله ، وفي وقوفكم مع الحق والعدالة ونصرة بيت المقدس

Petition to Majlis Al-Shura in relation to the Palestinian Cause and the Israel Boycott Law

Stemming from our firm beliefs, and the right of Omani citizens to participate in public affairs in accordance with the Basic Statute of the State, and based on the right of the Council of Oman to propose draft laws and refer them to the Government for study and approval, and in light of the blatant aggression against the heroic Palestinian people, especially in Gaza, and the current circumstances of continued escalation of violence and attacks on children and innocents, and the commission of public massacres by the Zionists, which constitutes a flagrant violation by Israel of international law, UN resolutions, human rights covenants and norms, and all principles of humanity;

And following the international efforts to hold Israel accountable and prosecute it for these repeated violations, including the case filed by the State of South Africa before the International Court of Justice against Israel for committing crimes of genocide in Gaza, and our pride in the honourable foreign policy of the Sultanate of Oman in support of the Al-Aqsa Mosque and the Palestinian cause under the leadership of His Majesty Sultan Haitham bin Tariq - may God preserve him and protect him - to restore all the legitimate rights of the Palestinians;

We, the loyal people of Oman, submit to the the elected Majlis Al-Shura to urgently take the necessary measures to achieve effective solidarity and genuine support for the Palestinian cause. We trust that the Majlis Al-Shura will exercise all its powers in accordance with the powers stipulated for it in Articles 48, 57, and 59 of the Law of the Council of Oman to achieve the following:

1. Compliance with Israel Boycott Law (Law 9/72) and requiring the relevant authorities to include the boycott in regulations and contracts

We request the Council to address all relevant authorities immediately to confirm the rule of law and take the necessary measures to implement the Israel Boycott Law (Law 9/72). We submit a request to update all contracts, policies, and regulations for purchases and investment regulations of the Government of the Sultanate of Oman and its owned companies to ensure a boycott on all levels and to restrict any commercial dealings with Israel or Israeli entities and individuals, directly or indirectly.

2. Completing the proposed amendments to the Israel Boycott Law

The esteemed Council, in its ninth term and in its regular session of the fourth annual session 2022-2023, discussed a proposal to amend the Israel Boycott Law, but the proposal was limited and did not progress. Therefore, we request you to conduct a comprehensive review of the aforementioned law and update it in a way that is compatible with the critical circumstances. We propose that the law includes all aspects of boycott and sanctions, including commercial, financial, cultural, sports, military, civil, travel and preventing Israeli planes from flying over Omani airspace. It should also include banning travel to Israel and preventing Israelis from entering the Sultanate's territory, even through the unified Gulf visa, or through the practices of the Middle East Desalination Research Centre in any way.

3. Proposal to designate a day per year in the Sultanate of Oman called Palestine Day

We submit a proposal to allocate a day a year to confirm the position of the Sultanate of Oman and their great interest in the Palestinian cause and taking any necessary steps that would achieve support for the brotherly Palestinian people and bringing peace and justice through the establishment of the State of Palestine with Jerusalem as its capital.

We are confident that the above proposals will be approved and implemented in record time, God willing and that you will stand with truth and justice and support the holy Jerusalem.
