We, the undersigned, do hereby protest the results of the voting at the Dancing Bear Property Owners Association (DBPOA) annual meeting held on February 18, 2016. At the meeting, votes were cast, including a surprise write-in candidate for the Board of Directors. Although write-in candidates are allowed, there was a call for nominations from the floor before the vote but there were none.

When asked to provide vote counts for all of the Board and ACC positions, it became clear that a single interest ("TLF6") desired to determine the outcome of each one. The handout from the annual meeting stated that there are 471 votes to be cast and the single interest ("TLF6") controls 206 votes, which is 44% of the total. However, as per the CCR’s and confirmed by CIA Services, this interest ("TLF6") only pays 50% on each lot it own so it appears that it provides only 28% of the annual assessment income.

We ask that those who got into their office via the votes from these single interests ("TLF6") step down-especially those that live in this community. Please see the current and proposed results in the image above that honors the popular vote but allow the outside interest to have a second seat on the Board of Directors.

Please limit the signing of the petition to property owners. For example, if a husband and wife own a property jointly, then only vote twice. Otherwise, vote once.

The feedback I have received from many property owners confirms that the current influence of TLF6 on our board elections remains a primary concern for our community. I am currently gathering formal documentation regarding the voting discrepancies to determine the most effective way to address this with our management company.

While I disagree with the manner the election was conducted, I believe the results are legitimate. TLF6 should be paying full maintenance fees for each property it owns.

Why even waste peoples time to vote when the results are already known beforehand.

I don't necessarily think any of the new Board/ACC members should step down, as they may do a great job as members of our Board. But I do protest the fact (if true) that TFL6 holds the same number of votes that landowners/homeowners do but yet they only pay half the amount of dues. This should definitely be addressed and amended for future elections.

I think it's always good to review votes for the security of the POA and peace of minds of the owners.
