The determination of whether or not a permit is required seems vague per the following link https://prescott-az.gov/wp-content/uploads/2026/01/BLD-FORMS_2026-WHAT-NEEDS-A-PERMIT-20260101.pdf At the very least I believe Theo’s should be able to make an application to have their art approved and to modify it to be in compliance rather than be required to remove it entirely. The city has an opportunity to demonstrate goodwill to a merchant who is a good neighbor to the neighboring community.

Tasteful branding like this adds to a town's character. It is nothing like annoying lights, or large signs advertising the business. It's a harmless design as part of the building's exterior painting. This is a waste of the city's time and resources.

This artwork is in proportion to MANY other business signs throughout downtown. Perhaps process wasn’t followed but a variance seems very reasonable for something that isn’t offensive or distracting and poses no threat to the public.
