Article II of the United States Constitution concerns the office of President of the United States. At the time the Constitution was written by the Founders in 1787 only men could hold public office and only men could vote in elections of public officials. It would be absurd to suggest that the founders were considering a woman qualified to be the "person" as referenced in Article II or that term person did not reference a male. They used 18 male pronouns in Article II! It took 133 years of petitioning by women suffragetts before the Nineteenth Amendment was passed in 1920 to allow women to vote. No woman has been elected president and the Nineteenth Amendment does not change the wording of Article II which specifically identifies the person of the President by the use of 18 pronouns of his, he or him. A nation of law requires that laws be written and published so that every citizen may know and see what they live under. We cannot change laws by abusing them. For a woman to be President the way needs to be legally paved in written law either by an amendment to the constitution or by a ruling of court to grant that right. It takes the congress too long to get its act together. It is the duty of the United States Supreme Court to advance that right. It may do so upon the petition of the people of the United States or upon a fiat ruling of its own initiation. We need to petition the Supreme Court to do so to clear the way for a woman to be elected to the office of President as soon as the year 2012 National elections.
