The First Minor Penal Court issued on 16/8/2012 ,an arbitrary verdict against the rights activists Nabil Rajab, of three years imprisonment in addition to previous three months imprisonment verdict, on calling for unlicensed gatherings. The two verdicts, the one related to alleged indignation of respected Muhraq citizens and the other alleged call for unlicensed peaceful gathering, are nullified verdicts, if we consider international law and national legislations related to demonstrations and gatherings, which do not prohibits peaceful demonstrations and gatherings , but rather regulate it within the framework of preserving the public order , protecting the demonstrators and clearing their way.Thus within this context , we assures that it is the state which abuses the law by prohibiting peaceful demonstrations and gatherings ,which are constitutionally guaranteed. This situation leaves no choice before the citizens, including Nabil Rajab, but to demonstrate and gather, to express their opinion, which is guaranteed by the Constitution of The Kingdom of Bahrain, The National Charter, The ICCPR, where Bahrain is a party, which are within The International Covenence of Human Rights. This verdict is politically motivated with object of vengeance. Emanating of that, the Observatory calls upon the rights societies and personalities to urge the Bahraini authority to release the rights activist Nabil Rajaband all prisoners of conscience immediately. We appeal to all Bahraini , Arab and international political and rights organizations and the UN, to intervene to release Nabil Rajab and all prisoners and detainees of conscience in Bahrain
