The purpose of this petition is to request a special meeting for the following:

  1. Discuss grievances concerning how current board meetings are conducted:
    1. Request changes in the way meetings are currently conducted (muting of all participants as opposed to an open forum)
    2. Creation of a general document to be sent out alongside all future board meeting communications that advises owners of the general rules surrounding board meetings as well as the option of proxy
    3. Discuss the lack of documentation that the bylaws allow for a fee to be associated with any leasing permit
  2. Discuss, formally request, and revote on the annual budget
  3. Formally request the following documents be created where required and made available to board members
    1. In-depth expenditure reports
    2. Copies of contracts which the HOA is currently beholden to
    3. Reports documenting current past due balances/payments of HOA to utility companies
    4. Creation of a fee schedule
  4. Discuss, request, and vote if required concerning grievances regarding the community in its current state
    1. Lack of repairs or maintenance completed
    2. Lack of communication from the board regarding bills or any other grievances
    3. Removal of NES and replacement with Dekalb water
    4. Removal of 100/day fee on accounts due to leasing restrictions
  5. Removal of Old Directors and an Immediate Election of new board
    1. A board election has not been conducted in several years
    2. The current board must be removed as not one of its currently standing members have been elected and a general election must be held
    3. Removal and election of board members as allowed in section III pg 4 per the bylaws
    4. Some of the board members are not currently supposed to be active directors.
  6. Discuss the creation of several committees
    1. Board Spending & Oversight
    2. Maintenance
    3. Renovations
    4. Accessibility
    5. Funding
    6. Tenant
  7. Formally request, discuss where required, and vote on the following changes to be made to the bylaws
    1. Change current leasing restrictions and requirements - allow for leasing permits to be issued, but discuss, change, or add several items around them:
      1. Leasing caps
      2. Fees surrounding permits if any
      3. Other leasing restrictions
    2. Change current rules regarding board eligibility
      1. Allow for investor owners to be on board
      2. Current on HOA dues requirement changed to no more than 90 days behind
    3. Change bylaws to call for a special meeting/election in the event that no current board members have been elected by the community due to appointments.
      1. Any board members currently filling a role due to appointment must be removed from said role at the annual meeting and allow for a general election to fulfill said role.
    4. Removal of current leasing fee charge of 100/day on accounts
    5. Removal of the water utility from being considered a special assessment and used to prevent individuals from voting
      1. Taking steps to remove the water utility from the HOA entirely by going through Dekalb county.
