On June 20, U.S. District Judge Jose E. Martinez declared Florida's death penalty unconstitutional because jurors are not required to make findings beyond a reasonable doubt on the aggravating factors that can increase a guilty defendant's sentence from life to death. The ruling mandates that defendants have a Sixth Amendment right to have all essential elements of proof in criminal cases found by a jury rather than by a judge. Due to this the Florida supreme court overturned two death penalties on the same date for Roy Phillip Ballard and Kevin Jerome Scott. However Gov. Scott declared that he prayed before deciding to sign the death warrant for Manuel Valle and God revealed to him that it was the right thing to do. We find this claim absurd and that no one can claim to be signing any death warrant in the name of god. We encourage you to therefore sign this petition on the fact you find these claims ridiculous and ask for the governor to seriously re-think his values in the name of God.
