Not all "veterans" receive medical treatment for serious injuries incurred in the line of duty while on active duty. A group excluded from treatment are those suffering a serious injury prior to the accumulation of 90 days of continuous active duty. These individuals are denied a DD214. The DD214 is the key to veteran's benefits, including medical treatment of line of duty service related injuries. The purpose of this petition is to correct this error for future "veterans" by having the nation grant medical treatment benefit to all "veterans" injured in the line of duty. To illustrate the situation I will briefly state my situation. I was an enlisted person and a midshipman (while maintaining my enlisted status). While on deployment with the Marines for training purposes as a midshipman I incurred a serious head trauma that has resulted in recurring migraine headaches and a constant moderate pain in the skull for the past 50+ years. As a result of my injury my midshipman appointment was terminated and I was issued a involuntary Honorable Discharge. According to my separation papers and statements made at the time the separation was a result of continuing headaches from the injury. I was not issued a DD214 because although I had about 200 days of active duty I did not have 90 days of continuous active duty prior to the injury. Because I did not have a DD214 I received no medical treatment for the injury after separation. The purpose of this petition is to see this 90 day exclusion done away with and for all "veterans" to be granted continuing medical treatment for injuries incurred in the line of duty while serving on active duty in the armed forces.
