Amending the Recusal Law (28 U.S.C. Sec. 455)

Judge Berrigan should not be censured, she should be removed from the bench and disbarred. She should not be a trier of fact or an attorney. She abused her discretion, committed fraud upon the court, judicial misconduct, and denied the rights of a litigant protected under U.S. Const. amend. V and U.S. Const. amend. VII.

I go to see their pictures, even the ones who claim to protect your constitutional rights, but in their eyes I see secret defenders of the state. They claim to have a good relationship with judges and even law enforcement, like that's a good thing. And should I pay them to pretend to defend me??? I have no choice. My trial judge would not look me in the eyes from the time she rendered her unlawful decision against me to her exit out of the room. Can you guess what state or nonstate I live in? I was a victim of such egregious problems in Canada. The judge had funded a named scholarship fund at the university that intervened in a case against me funded by the university. I sought recusal of the judge all the way to Canada's supreme court.

I am currently in the same situation, left with no attorney, going through probate and I van not get a lawyer to represent at all my last lawyer told me that the court assistant would not allow them to submit. I am going out of my mind and can't do a thing about it. Hopeless.

After disregarding my father's will and appointing an administrator, the judge went to work for the law firm he appointed. Nearly 8 months after submitting my claim based on a promissory note against the estate they offered partial payment. I refused and file a case. They sought summary judgment claiming that their motions to extend time to respond to the claim caused the statute of limitations to run. Other than the fact that that was extrinsic fraud, I was able to defeat that due to the lack of an unambiguous statement. 8 years would pass, getting the first judge to do a 41b dismissal. In the second case, summary judgment was pending with the defendant stalling with the only thing left a 56f motion. Despite insufficient requisites, I relented and sat through a 3-hour Depo. Now with no defenses left he stalled the answer for another 6 weeks making the deadline the day of a new pre-trial conference which I had no idea was happening. Without any prior warning and a summary judgment motion that had been answered to rule on, the judge dismissed the second case with prejudice. The Appellate Court denied my 60 (B) motion confusing me and precluding me from responding to defendant's motion contra. These are some sick people. The trial judge also finally denied my 60 (b). My case is so obvious that I feel like I should be able to get somebody to stop this. I called innumerable law firms and not one called me back.

This seems like a common sense idea. Even if an individual judge thinks he or she can render impartial judgment in such a case, the appearance of conflict is bad and should be avoided.

The failure of ethics among judges is unfortunately not uncommon. Congress needs to address this.

I agree that this would help address a serious issue. Universities play a vital role in democracy, which means requires special attention to ensuring they operate with integrity and subject to the rule of law, not arbitrary power and wealth.

The time has arrived for amending the Recusal Law (28 USC Sec. 455). Federal judges have no business whatsoever serving as an instructor or on an advisory board of an educational institution that is a party to the proceedings. Furthermore, the House and Senate Judiciary Committees should be holding hearings on complaints against federal judges who have been accused of impropriety via conflicts of interest in cases. As it now stands, the system is a self protective essentially cover up system where only brethren judges review complaints against judges that are brought by the people. It is a very dishonest and corrupt system calculated to cover up wrongful and illicit activities by federal judges. It is a widespread problem in the judiciary. There should be congressional hearings on this subject with people allowed to come in and show their evidence. The crimes by federal judges against the people are many. Definitely there is a need to amend the Recusal Law (28 U.S.C. Sec. 455).

FOIA suits against the Judicial and professional conduct boards demonstrate the boards do not discipline errant lawyers and judges. The board chairs often claim there is not sufficient funding for investigation and No funding for prosecution, year after year. Yet it is the Supreme Court justices who allocate funding no funding for investigation or prosecution but they can give themselves raises, Impeachment was intended to discourage errant behavior in the entire history of the U.S. there have been just over a dozen impeachment’s of Federal judges. Lawyers dominate every branch of government and make it serve their interests. Those of conscience are being diagnosed clinically depressed and advised to find other work.

This is a good initiative, but we need much bolder measures that put the authority of the U.S . Constitution directly into the hands of the people. Citizens must have authority to handle judicial abuse on the spot.

Got so trashed in 2001 2003 by judges in ca state and 9th district court up to federal appellate court. I had no idea, the courts were so rigged too. Women and minorities in the workplace suffered and via the ca WCAB. This was all a concerted effort to harm employees and yet to this very day , ALJs and state and federal court judges get to do the most harm, knowingly taking away and violating our constitutional rights and civil liberties with impunity and such unmitigated gall and such total disregard for the law of the United States of America. This has been one heck of an education plus the public isn’t even aware in well over 30 years that their lives with families will be totally destroyed once a mother or father gets injured on the job. No public awareness and certainly no access to justice

I'm going through the same thing. I came across this case and I'm amazed how hard Dr. Carl Bernofsky fought for his rights. my deepest condolences of his loss to his family. I am using his case to help my case which is similar of what I'm going present.

Courts have stripped me of my livlihood....by allowing corruption in the courts by state officers and the judges turn their head and look away shove it under the rug and act like it never happened
