بيان حول أعمال "اللجنة الدستورية السورية"

بعد أكثر من عامين على إطلاقها والإشراف الروسي على عملها، تحولت "اللجنة الدستورية السورية" التي نتجت عن مؤتمر سوتشي ومسار أستانا إلى وسيلة لكسب الوقت في اجتماعات توصف زيفاً بالعملية السياسية على حين أنها فعلياً تجميدٌ للحل السياسي المستند لبيان جنيف 2012 وقراري مجلس الأمن 2118 و 2254 الذي سينهي معاناة السوريين، ويحقق طموحهم بإقامة نظام سياسي ديمقراطي وعادل.

لم تكن المسألة السورية يوماً مشكلة دستورية، ولا يرتبط الصراع السوري بالدستور إنما بمن يستخف بالدستور والقوانين وحياة الناس. إنها قضية شعب ثار من أجل الحرية والكرامة على نظام متسلط قاتل، دمَّر البلاد وهجَّر الشعب، وعاث في سورية فساداً وتخريبا. باع مقدرات البلاد ومؤسسات الدولة ومصالحها، ورهنها للمحتلين الذين أبقوه على كرسي الحكم وفوق أعناق الشعب.

إن تقليص الصراع في سورية إلى جملة من النقاط تم وضعها في سلال، واختيار إحداها لتكون أساساً للحل يشكل تطاولاً على مرجعيات العملية السياسية والتفافا بيناً على القرارين الأمميين 2118 و2254، يحرف مسار الحل السياسي التفاوضي عن أسسه القانونية. إذ تنص المرجعيات الدولية بوضوح على أولويات الخطوات التفاوضية والتطبيقية للحل السياسي بدءاً من الانتقال السياسي وتأسيس هيئة حاكمة كاملة الصلاحيات التنفيذية لتشرف على البيئة المحايدة المناسبة والضرورية لصياغة الدستور بأدوات ديمقراطية وإجراء الانتخابات ضمن مناخ آمن وبضمانات قانونية وإشراف دولي. إن ما يجري تحت اسم " اللجنة الدستورية " يعطي رسالة زائفة وينشر الوهم الكاذب عن استمرار العملية السياسية في وقت يتم فيه تشويهها والتطاول عليها لحرفها عن مسارها، وإيجاد بديل عن العملية السياسية الحقيقية التي رسمتها القرارات الأممية، وأقرتها الإرادة الدولية، ووافقت عليها قوى الثورة والمعارضة.

لم يفوض الشعب السوري أحداً بتسمية لجنة دستورية ووضع دستور. كما لم تخول القرارات الدولية روسيا الاتحادية أو غيرها من الدول أو المنظمات بما فيها الأمم المتحدة بفرض لجنة تضع دستوراً للسوريين. فالدستور السوري من اختصاص السوريين ومن مهام المرحلة الانتقالية، تضعه داخل البلاد جمعية تأسيسية منتخبة تمثل جميع مكونات الشعب، ويتم إقراره عبر استفتاء عام. وغير ذلك تهاون وتفريط لن يكون مقبولاً من السوريين، ويشكل استهانة بتاريخهم واعتداء على حقوقهم وكرامتهم، ولن يسهم إلا بزيادة مأساة الشعب وإطالة أمد المحنة السورية.

يصر السوريون على حل سياسي تفاوضي بدعم من المجتمع الدولي ومن الدول الصديقة ضمن أطر المصلحة الوطنية للثورة السورية ولعموم البلاد، وإن أي تحرك خارج هذا الإطار سيصب في مصلحة تكريس الاستبداد والتخلي عن هدف تحرير الوطن من التسلط والقهر والفساد الذي قدم السوريون كل غالٍ لتحقيقه.

نرى أن الحل السياسي يجب أن يعود إلى مسيرة العملية السياسية التي تم تحديدها في قرار الجمعية العامة للأمم المتحدة 262/67 وقراري مجلس الأمن 2118 و2254. ولذلك نهيب بالمجتمع الدولي أن يدعم المسار الحقيقي للعملية السياسية واستئنافها، وندعو جميع السوريين وقوى الثورة والمعارضة للتنبه إلى خطورة ما يجري والالتزام بالخط الوطني الداعي إلى الانتقال السياسي الذي يقود إلى سورية ديمقراطية حرة، وعدم منح نظام القتل والتدمير -من خلال أعمال هذه اللجنة ونتائجها - أي فرصة لاستعادة شرعية زائفة ودور مفقود.

إن التحركات السياسية الحالية تحت عنوان "اللجنة الدستورية" وأعمالها سوف تسمح باستمرار الهيمنة وإعادة إنتاج النظام بانتخابات غير شرعية والاستمرار في حكم البلاد بالعنف والفئوية من خلال الأجهزة الأمنية. وتنال من حق الشعب السوري في تثمير تضحياته لصنع مستقبله ومصيره.

Statement on the "Syrian Constitutional Committee"

Two years have elapsed since the launch of the “Syrian Constitutional Committee” with no tangible outcomes. The Committee has been closely managed by the Russians ever since it was engineered in was the Sochi Conference, and its agenda was developed in the Astana track. The process that led to its formation resulted in a body more responsive to the dictates of Russia and regional powers than to interests and concerns of the Syrian people, and has recently become a tool used by Russia to buy more time for the Assad regime. Indeed, the current agenda and timetable has led to freezing the initial negotiations for a political solution based on the ground rules and objectives set in Geneva Communique of 2012, as well as the Security Council Resolutions 2118 and 2254. The implementation of these legally binding resolutions would have ended the suffering of the Syrians and fulfilled their reasonable demands to establish a democratic and just political system.

The Syrian demands for change cannot be reduced to a constitutional process, and the Syrian conflict is not confined to the constitution, but rather to the misuse and abuse of the system of law and order. The Syrian people who took to the streets demanded freedom and respect for human dignity against, and an end to the authoritarian regime that destroyed the country, displaced the people, and sanctioned corruption and abuse of power. This regime has sold the country's wealth, state institutions and interests, and presented them to the occupiers in exchange for protecting the corrupt elites from the Syrian people.

Reducing the conflict in Syria to a number of technical issues organized into four baskets, and focusing on only one of them, namely the issue of constitutional reform, is an open violation of the political process and a serious circumvention of the UN Resolutions 2118 and 2254. Moreover, the current process distorts the path of a negotiated political solution and deprive Syrians from pursuing a legitimate political settlement. Security Council resolutions set clear priorities for the negotiations and implementations, and outlined a number of steps for a meaningful political solution. The steps should clearly starts with the political transition and the establishment of a governing body with full executive powers to oversee the appropriate and necessary neutral environment. In such environment, the drafting of a constitution with democratic tools should take place and only then elections could be conducted in a safe environment with legal guarantees and international supervision.

The activities performed under the banner of “Constitutional Committee" is definitely giving a false hope and creating illusions about the continuation of the political process at a time when it has been practically derailed. The formation of the “Constitutional Committee” is an attempt to substitute the real political process that was drawn by UN resolutions, approved by the international community, and accepted by the forces of the revolution and the opposition. .

It is also of paramount importance to make clear that the Syrian people have not authorized anyone to appoint a constitutional committee. The UN related resolutions did not allow this appointment; particularly they did not authorize the Russian Federation or other countries or organizations, including the United Nations, to impose a committee to draft a constitution for the Syrians. The Syrian constitution is the prerogative of the Syrian people and one of the tasks of the transitional stage. Drafting the constitution during that phase should be performed in Syria by an elected Constitutional Assembly to legally represent all the people. Insisting on imposing the committee on the Syrian people amounts to complacency and negligence that will not be acceptable by Syrian people. Further, the current process undermines the will of Syria people and is an unacceptable assault on their rights and dignity, and will only contribute to the increase of the Syrian tragedy and the prolongation of the people’s ordeal.

The Syrians insist on a negotiated political solution with the support of the international community and the friends of the Syrian people within the frameworks of the Syrian national interests of the interest of Syrian people as a whole. Any move outside this framework will serve to perpetuate tyranny and abandon the goal of freeing Syria from authoritarianism, oppression, and corruption that the Syrians have paid the ultimate price to achieve.

We believe that achieving fair political solution requires the return to the political process defined in United Nations General Assembly Resolution 67/262 and Security Council Resolutions 2118 and 2254. We call on the international community to support the resumption of the process as defined in the above resolutions. We also call on all Syrians to be alert to the risks and dangers of the current process. We urge the Syrians to adhere to national unity by demanding a political transition that leads to a free, democratic Syria, and not to grant the criminal regime - through the work and results of the “Constitutional” Committee - any chance to regain undeserved legitimacy.

The current political diversion under the heading of the "Constitutional Committee" will allow the continuation of hegemony, the reproduction of the regime with illegal elections and the persistence of the rule of violence and brutal practices of the security apparatuses. This will undermine the right of the Syrian people to invest in their sacrifices aims at creating a better future and a brighter destiny.
