The Cuban Exile Community Requests the Immediate Reactivation of Processes Under the Cuban Adjustment Act

On behalf of those of us affected by the unjustified and unreasonable delays in the adjudication of applications under the Cuban Adjustment Act, we respectfully request judicial intervention through a writ of mandamus and pursuant to the Administrative Procedure Act (APA). These prolonged delays constitute an unlawful failure to act within a reasonable time and a breach of the agency’s mandatory duty to adjudicate eligible applications. Such inaction has caused significant harm to a broad group of similarly situated applicants, affecting their legal stability, employment, and family unity. We therefore request that the Court order USCIS to resume and promptly adjudicate all pending Cuban Adjustment Act cases without further unreasonable delay.
