This would be a good solution to the problem of unscrupulous actors registering these instruments and holding homeowners hostage, and would be a lot cheaper than trying to police it through high fines. Good idea.

Only lawyers should have access to register discharges of private mortgages and it is my opinion that mortgage brokers/real estate brokers should not have the same access as discharge funds cannot be forwarded to them in trust and DRAs cannot be signed by them to complete the transaction and it is very frustrating when I have to deal with such parties that cannot be held accountable. Issues have also arisen with NOSIs and many times the unacceptable late response of the secured creditor company threatens to jeopardize the transaction. Only lawyers should handle these types of matters.

I frequently deal with fraudulent registrations of Notice of security interest. The cost is too low for unscrupulous parties to register NSI. How, the consequences are grave and the costs are too high for home owners to fight it.
