Transphobic comments were made during a morning show on the 3/11/09 and today 9/11/09 on Nova during the Breakfast program. For nearly 5 minutes on the 3/11/09 Transgender people were discriminated against and vilified on air by Meshell, Ash and Tim with Ben Teo. This was a blatant vilification attack on Transgender community and also was placed on the Nova Website as a podcast and left up for nearly a week for public download. Nova has done this on several occasions and after many complaints they continue to breed hatred over the radiowaves. Proscribed Matter 1.3 A licensee must not broadcast a program which: (a) is likely to incite, encourage or present for its own sake violence or brutality; (b) simulate news or events in such a way as to mislead or alarm listeners; (c) present as desirable: (i) the misuse of alcoholic liquor; or (ii) the use of illegal drugs, narcotics or tobacco. (d) depicts suicide favourably or presents suicide as a means of achieving a desired result; or (e) is likely to incite or perpetuate hatred against or vilify any person or group on the basis of age, ethnicity, nationality, race, GENDER, SEXUAL PREFFERENCE, religion or physical or mental disability.
