Toast Restaurant Point of Sale company has, without our consent, implemented a $0.99 processing fee for all online orders, both take-out and delivery. This is, at a minimum, unethical and quite possibly a breach of a contractual agreement made between Toast and its customers, the restaurant owners.

Toast customers (the restaurants) make a contractual agreement, typically 3 years, with Toast, and are required to pay a monthly fee for the "online ordering" feature. This fee is agreed upon up front and, as the customer understands, is in place in order to avoid additional fees placed on the restaurant's own customers. The restaurants are also required to use Toast for credit card processing for all credit card orders as part of the contract as well. The newly implemented $0.99 "online ordering processing fee" is collected by the restaurant but then paid to Toast, resulting in a very bad image for the restaurant, as it appears the restaurant is keeping the fee, from the restaurants’ customer's perspective. We, the restaurant owners (Toasts' customers), are outraged by this unethical, and potentially illegal, implementation of this fee. At a time when consumers are already feeling “nickeled and dimed” by high prices, Toast is putting us in very precarious situation.

Toast has provided a weak argument for this fee, claiming this fee is way for them to avoid the higher commissions charged by other third parties such as Doordash and UberEats. This is a false argument as those third party delivery companies are not companies that we signed agreements with to utilize their hardware and software as our point of sale. Those companies also charge commissions because they have enormous platforms in which they digitally market the restaurants to. Toast does not do this. Toast, for all intents and purposes, has implemented this fee as a “money grab” as they know we are contractually obligated to utilize their services for a predetermined amount of time. And further, even if we wanted to break the contract, Toast is aware of the disruption it would cause to our business to do so.

The bottom line is this. Toast has apparently found a back door way to increase costs to us, by indirectly charging our customers to use our point of sale. Toast can say that it is not an increased cost on us because it is our customers that pay the $0.99 fee, but common sense should prevail here, and we know our customers will choose to go elsewhere when they see this fee, therefore costing us revenue, nevermind the damages to our brand. Had Toast divulged this fee before we signed a contract with them, most of us would have never moved forward with them. We chose Toast believing we could trust them. They have breached this trust.
