STATEMENT OF PURPOSE

We, the undersigned trainers, owners, breeders, veterinarians, and concerned citizens, respectfully urge President Donald J. Trump and Congress to support the immediate repeal of the Horseracing Integrity and Safety Act (HISA). While we share the goal of protecting our athletes, HISA as currently implemented is an unconstitutional federal overreach that threatens the economic survival of our sport.

GROUNDS FOR REPEAL

UNCONSTITUTIONAL POWER GRABS

The HISA framework violates core constitutional principles. The U.S. Court of Appeals for the Fifth Circuit has repeatedly found that HISA violates the Private Nondelegation Doctrine by granting federal investigative and enforcement power to a private corporation—the Horseracing Integrity and Safety Authority—without adequate oversight. Furthermore, its adjudicatory process denies participants fundamental Due Process rights.

ECONOMIC DESTRUCTION OF THE SPORT

HISA is an unfunded mandate that is "taxing" the backbone of the industry out of existence. Exorbitant compliance fees and assessments disproportionately harm independent trainers and smaller tracks. This "one-size-fits-all" model ignores regional realities and risks shuttering family-run operations across the country.

FEDERAL OVERREACH VS. STATE SUCCESS

HISA unconstitutionally commandeers State Sovereignty, stripping power from state racing commissions with decades of expertise. We call for a return to state-driven oversight, as proposed in the Racehorse Health and Safety Act of 2025 (H.R. 3378), ensuring racing is governed by science and regional expertise rather than federal mandates.

CALL TO ACTION

We, the undersigned, call on President Trump and Congress to repeal HISA and replace it with constitutionally sound, state-led safety frameworks to preserve the future of American horse racing.
