Pointe HOA in Boise had their annual fees at $500 and now the board
members want to increase their annual fees by 30% which brings it to
$650 a year. The clubhouse rental fees also increased from $100 to $200
but at least those fees are optional. With that being said, where did all of those fees go from the clubhouse rental? It isn't on the financials. That is a massive amount of revenue coming in that could be used in lieu of raising the dues annually. Overall, The
HOA board isn't complying with my requests in getting an external audit, which is a RED FLAG to me. IMO They have failed to provide any supporting
documents to justify their fees (including the increase) as well as
declining us with copies of the association’s records, including
factual financial documents (statements, and audits), vendor contracts, receipts, invoices,
tax returns, etc. The fees on their budget appears to be immensely over-exaggerated. We need board members that we feel truly have the best interest of the homeowners and the current board members don't appear to even take any of the homeowner's feedback into consideration regarding the rejection of the increased HOA fees IMO.
When requesting an external audit from the HOA board to verify the allocation of the funds, our request was continuously denied to obtain copies of receipts. On top of that, I personally didn't even find the original $500 annual fees justified since the HOA hadn't addressed any of my prior concerns, has been poorly maintained and now they want to charge everyone $650 annually, which doesn't seem right. IMO budgeting also needs to be more capable and shop around for reasonable offers if they are claiming the amounts are accurate, although their large amounts are hearsay as of now since they are refusing to provide any supporting documents or let us get an external audit. IMO they are failing to be transparent by not showing factual spending amounts, because even just the $11,000 that they claim they are spending on "copies, checks, envelopes and postage" seems absurd and inflated to me. This would not cost me over $1,000 in total for all of that. Some of the other expenditures on the 2024 budget appear to be overstated or exorbitant as well to me. It would be beneficial to also replace some or all of the current HOA board members.
It looks like there are 1,221 homes in our Charter Pointe subdivision. If each unit pays $500 then they would have a total of approximately $610,500 per year (already over half a million dollars) and approximately $67,200.00 for the 128 Alley Load houses from everyone, plus the revenue of the clubhouse rentals, all in which are a very large sum of total revenue and now they are wanting to increase that to $650. If each unit pays $650 with 1,221 homes that would be a total of approximately $793,650 and approximately $72,960.00 for the 128 Alley Load houses, plus the revenue of the clubhouse rentals which is also monumental. Both amounts are very large in revenue and for exactly what? What is the HOA board doing with such large sums of money each year? This doesn't seem justified to me.
Per the Idaho Statues; Title 55, Property in General, Chapter 32, Homeowner's Association Act, Section (e) - "A provision that no fees or assessments of the homeowner’s association may be increased unless a majority of all members of the homeowner’s association vote in favor of the increase."
Those that attended the HOA meeting in November also claimed that they were hindered from speaking about the unjust increase of the HOA fees and the December meeting is cancelled. Another challenge the HOA board faces, aside from the inconvenient timing with these "meetings" (which are generally held during rush hour) would be ensuring accessibility and inclusion for all members. It has come to my attention that the HOA meetings may not suitable for people with disabilities, as they can have difficulties with communication, transportation to attend the meetings in person/being mobile, including having difficulty with technology to access the meetings online, which impacts their overall participation, I.C. § 67-5909. Therefore, their input cannot be taken into consideration which is considered to be discriminatory.
To provide a general idea, these are the other local HOA fees (Boise, 83709):
- Edgeview Estate HOA- $252 annually
- Huntwood HOA - $276 annually
- Cornerstone HOA - $280 annually
- Ethridge Square HOA - $300 annually
- Lakeridge HOA - $310 annually
- Blue Meadows HOA - $312 annually
- Sequoia Grove HOA - $350 annually
- Chase Street Cottages HOA - $400 annually
- Mountian West HOA - $400 annually
- Anter Ridge HOA - $420 annually
- Muir Wood HOA - $480 annually
- Crosswinds HOA - $504 annually
Insurance should be able to cover some of the repairs that they are trying to take out of our funds. We should know exactly where our money is going and how it is spent factually, as well as how much revenue we are generating (including the revenue from the clubhouse rentals). Also, under the documents where it says “Financials” that also isn’t transparent as it is heresy since there isn't any supporting evidence IMO. I can type up the same thing that someone did in those documents and put it in the same folder but that doesn’t mean it’s accurate if I don’t have any supporting documents. This raises questions about the board's accountability and integrity, and whether they are using the HOA funds appropriately IMO.
Based on my experience, I believe the optimal course of action would be to postpone the fee increase for 2024 until we have sufficient time to address this matter and remedy the situation that the residents are having with the substantial increase in addition to replacing some or all of the current HOA board members with members we feel are competent as I believe there appears to be a lack of fiduciary to the residents along with cryptic spending patterns that the HOA board refuses to explain. Every time I asked them about external audits to justify the amounts being spent, my requests have not been answered to a level of satisfaction. The increase is too high and the residents were not warned before the vote nor were they given a fair chance to vote. The other final course of action we need would be to revise the CC&Rs to include a clause that restricts the HOA from increasing our annual fees by more than 10% per year.
