We, the undersigned co-owners of units in the North Building of the Waterway at Hollywoood Beach, Florida, are formally expressing our deep concern and frustration regarding the persistent and unresolved issues with the building’s cooling tower system. This ongoing problem has resulted in frequent loss of air conditioning, especially for end-unit owners, creating unbearable living conditions, particularly during the intense summer heat in Florida.

Despite numerous emails, reports, and proposals submitted in good faith by residents — including suggested interim solutions and a formal Request for Proposal (RFP) — the Board has taken no concrete action to address or correct the issue.

It is clear that the root cause of the problem lies in the aging and inadequately maintained cooling tower, which contrasts starkly with the South Building’s system that was fully replaced in 2018. The lack of preventative maintenance, combined with the absence of a post-shutdown purging protocol, continues to deprive residents of their right to a safe and habitable environment.

We are further alarmed by what appears to be a pattern of selective responsiveness by the Board, prioritizing only certain owners while ignoring valid and repeated complaints from others. This is unacceptable and reflects a failure in governance and responsibility.

As such, we collectively demand that the Board:

1. Deliver a detailed written action plan within ten (10) business days outlining the steps and timeline for repairing or replacing the North Building’s cooling tower.

2. Establish a technician response protocol to ensure affected units are purged and properly serviced immediately after every tower shutdown or restart.

3. Communicate transparently and equitably with all co-owners, regardless of personal affiliations or voting history.

Should the Board fail to respond or act within the specified timeframe, we reserve the right to pursue legal action or regulatory intervention to enforce the Association’s obligations under applicable law.
