Regarding Properties at 2257 and 2241 W State Road 340, Brazil, Indiana

We, the undersigned neighbors and residents of Clay County, Indiana, formally request that the Clay County Commissioners take further legal action to compel the cleanup of the properties located at 2257 and 2241 W State Road 340 in Brazil, Indiana, and to require removal of the industrial-style fence if deemed appropriate under county ordinances and community standards.

For several years, these properties have contained large amounts of trash, debris, abandoned and non-operational vehicles, semi-trailers filled with refuse, and other materials inconsistent with residential property maintenance standards. The conditions resemble those of a commercial junkyard rather than residential property and have significantly impacted the surrounding neighborhood.

The County has previously cited the property owners on three separate occasions for ordinance violations. Fines pertaining to the last of these actions are still being paid.

In spite of these fines, and despite the enforcement actions, the properties remain in violation and have not been brought into compliance.

We understand from the County Attorney that Clay County’s primary objective is not financial penalty, but compliance and restoration of the properties. The County has indicated a willingness to work with the owners regarding unpaid fines if the properties are properly cleaned up. However, continued installment payments without meaningful remediation have not resolved the issue.

As nearby property owners and concerned citizens, we believe these ongoing conditions:

• Substantially diminish neighboring property values (estimated at a 20–30% reduction).
• Create visual blight inconsistent with the character of our community.
• Potentially present safety and environmental concerns.
• Negatively affect the quality of life for surrounding residents.

This petition demonstrates that this matter is not merely an isolated dispute, but a shared and widespread concern among neighbors and Clay County residents.

We respectfully request that the Clay County Commissioners:

1. Authorize further legal action to compel immediate and full cleanup of both properties.
2. Require removal of excessive debris, abandoned vehicles, trash-filled trailers, and other ordinance violations.
3. Evaluate and require removal of the industrial-style fence if it violates county standards or contributes to the nuisance condition.
4. Pursue enforcement to the fullest extent permitted by law if compliance is not promptly achieved.

Many of us stand ready to support the County’s efforts and, if necessary, provide testimony regarding the impact these properties have had on our neighborhood and community.
