I am here to start a petition in regards to my dear friend Michael Clements. Michael recently received a 7 year revocation in Washington County Oklahoma. The case that was revoked was a knowingly concealing stolen property case for a gift card he had found by a dumpster. Michael has been on probation since he was 18 for various charges. He is now 39 and this will make his fourth trip to the penitentiary. The revocation was started because Michael had picked up another charge of assault and battery (we all had been drinking and he and one of the neighbors had gotten into a verbal argument the neighbors wife called the police department and the police came out. Michael was not arrested on this until several months later. When he was arrested on it and court was coming around the neighbor filled out a waiver of prosecution form to not press charges and letting the DA know that this was their wishes.... Long story short after several court dates the charge was dismissed) He was required to get a mental evaluation at a mental health place here in town and this he did. He was also required to get an evaluation for drugs. The assessment for the evaluation was 99 dollars and took two weeks to get the results in. Upon awaiting the results is when he got picked up on the assault and battery case. He ended up doing something close to three weeks waiting for us to be able to acquire the money to post his bond. During this period the evaluation from his assessment had expired to allotted time frame for him to enroll in classes and another 99 dollars was required to take the evolution again. So in the application to revoke these were the things his probation officer had in the report. 1. Michael was picked up on new charges ( that were dismissed) 2 not attending classes and 3 the evaluation for mental health ( that is probation officer said he never got) Michael realizes that he probably didn't put forth is 100 percent on getting everything done in a quick manner and has had much time to think about this. He hasn't gotten any new cases that he has actually been charged with since 2008 passed all of his UAs ect. His father passed away in 2009 leaving him to care for his mother who is handicapped and two grandmothers one of which is also handicapped. He is also an only child and the only surviving male left to carry on the Clements name. I feel the sentence is extremely excessive. His mothers house is falling apart and his Grandmothers are getting up there in age. I have written a letter to the department of corrections here in Oklahoma asking for a modification to get him out on a leg monitor or a reduction in the amount of time they gave him that way he can come home and take care of his family who desperately needs him.
