Mr. Simeon D. Mokhiber is a US Army veteran who served for nine years. While deployed to Iraq, he served honorably as a non commissioned officer in the US Army Infantry in the 82nd Airborne Division. He also followed that by serving as a private security contractor protecting our US State Department employees.

Unfortunately, he is also the latest victim of the NY SAFE Act.

He was convicted on April 21st, 2017 in New York State of possessing "large capacity ammunition feeding devices" under Gov. Andrew Cuomo's SAFE Act. He was arrested for DWI after he asked the officer to turn his body camera on. Police later found three 17-round Glock magazines in a locked container.

There was no victim, no intent to do harm, not even a firearm in the vehicle or on his person! While Mr. Mokhiber is a licensed handgun owner with a registered handgun, NO firearm was in the vehicle at the time of the traffic stop. The jury found him not guilty on the DWI charge. He has no prior criminal record.

Each magazine can result in 7 years in prison. Simeon is potentially facing a 21 year sentence!

Most importantly, Simeon Mokhiber is the father of an 8 year old child with severe disabilities. This child depends on Simeon's care and would suffer greatly from the incarceration of his father.

His sentencing is on or about June 13th, so time is of the essence. Please sign this petition now...

Dear Hon. Matthew J. Murphy,

We, the undersigned, humbly plead for judicial leniency in the sentencing of Mr. Simeon D. Mokhiber who was charged and found guilty of possessing three 17-Round ammunition magazines.

Sincerely,

Fellow citizens of Mr. Simeon D. Mokhiber
