November 23rd, 2010 The Honorable Chris Christie Office of the Governor PO Box 001 Trenton, NJ 08625 Dear Governor Christie: As you are likely aware, many other states have recently filed lawsuits challenging H.R. 3590, the Patient Protection and Affordable Care Law. We are writing today to respectfully request you join these states in challenging the constitutionality of this measure. We believe that H.R. 3590 breaches Article 1, Section 8 of the United States Constitution, which grants Congress the limited power to “regulate commerce with foreign nations, and among the several states, and with the Indian tribes.” Further, Congress’ limited power does not include the right to regulate commerce on the individual level. Thus, we believe that mandating all citizens’ to purchase health insurance is in direct violation of the commerce clause. We agree that our nation’s health care system is broken and is in need of repair. However, we believe that Congress’ decision to require the citizens of New Jersey to purchase health insurance is an abuse of their limited powers. Therefore, we respectfully request that you consider adding New Jersey as a party to the pending lawsuit against H.R. 3590. Sincerely,
