We the residents of the community request that the Highland Sand & Gravel C&D Application be denied by The Village of Woodbury Planning Dept. & Board of Trustees not withstanding we believe the Zoning Board should rehear the issue of Non-Conforming use based on new information & the Planning Boards recent decision. Zoning decision was based on "Negative Declaration" being declared which has since been rescinded and as such should not stand.

310-43.2.Non-Conforming Use shall not be enlarged, altered, extended, restored, or increased by any means. Shall not be moved to location where use would be non-conforming. Shall not be reestablished if such use has been changed to or replaced by a non-conforming use.

We believe the Application is detrimental to property values, health, safety & general welfare. There are a number of reasons why this proposal should be rejected. The potential pollution of Woodbury Creek & Aquifer, >3.5 million gallons per month Woodbury Creek water withdrawals & already low water levels, air pollution, potential for even greater volumes of dust than currently exist, more noise from solid waste processing moved closer to homes, increased truck traffic in a residential area, etc.

For all these reasons this must not be approved. Rattlesnake dens & historically significant site should have been considered as well. Consider S310-22.Noise, Dust, Industrial Waste, etc. Consider S310-15.Prohibited uses C&D Dump, etc. Furthermore we do not believe public was properly notified of Zoning Board hearing on the matter.

Please stand with the residents of Woodbury and surrounding communities and reject this proposal.
