If the Nook club obeyed the COA sound level ordinance, then the Westin has no grounds for a suit. If the Westin is at fault, the Nook should counter-sue for harassment.

Westin you are messing with people's livelihood here. The Nook was there first! Go bully somewhere else and NOT in Austin! We have survived just fine without your shoddy construction on your so called grand hotel. You should have done your due diligence better and face the fact you messed up! Now, fix it and leave the small business alone!

So much of "Austin" is gone now. Just STOP! And leave things be. We grew like this because people are drawn to the way it is, not the way it will be. If that were the case they'd stay where they were.

Don't build a hotel next to a live music venue, then sue the venue because you can hear the live music.

I have no sympathy, if I'm tired I can sleep anywhere. People staying at the hotel should have the brains to realize or the DECENCY to move hotels mid-evening if they're such wusses. Music must live on!

As a downtown, taxpaying resident I am sickened by the slow and steady obliteration of Austin's downtown live music scene. One of the reasons my husband and I chose to live downtown was for the walkable lifestyle which includes dining and LIVE MUSIC. If you don't like noise, visit or live in the countryside!
