Service Corporation, Intl. of Houston, TX, owner of Oak Hill cemetery has proposed to buy a large portion of the 11 acre western side of Dairy Hill from the City for cemetery expansion. The original developer of our community was required to surrender this grassland for the creation of protected habitat for the endangered burrowing owl and tiger salamander, and for reforestation of native oaks. The hillside is maintained by neighborhood volunteers and the community facilities district. The current property line follows the contours of the hill so that the cemetery is hidden from view. If the cemetery were to expand over the crest of the hill, however, it would be visible from CA-87, Curtner Avenue and the nearby neighborhoods -- this would greatly change the character of the community. Some Asian residents have indicated that living in view of a cemetery would go against their beliefs. And property values would be adversely affected for owners who were told when they purchased, that the hillside would remain a permanent open space. We, the undersigned ask the San Jose City Council to deny the proposed sale and preserve this area as protected open space. We further request that the city not issue building permits for any new visible structures on the top of Dairy Hill.
