PETITION REQUESTING ADJOURNMENT OF MAHWAH PLANNING BOARD MEETING
To: The Planning Board of the Township of Mahwah,
THE UNDERSIGNED HEREBY PETITION the Township of Mahwah Planning Board to adjourn the upcoming Board meeting currently scheduled for May 24, 2021 regarding the land use application of the applicant Fyke Brook Estates, LLC for the property located at 1 Fyke Road, Mahwah, New Jersey 07430.
1. The Petitioners are residents and property owners of Rio Vista Mahwah Homeowners Association.
2. The property located at 1 Fyke Road, Mahwah, New Jersey 07430, also known as Block 21, Lots 21, 22 & 23, was recently re-zoned by the Town as a multiple dwelling; The immediately adjacent properties and neighboring community, including Petitioners’ properties, are zoned and continue to be maintained as single family homes.
3. On February 19, 2021, Fyke Brook Estates, LLC submitted an application to the Mahwah Planning Board for the proposed development of a multiple dwelling rental complex on the subject property referenced above.
4. Due to the restrictions imposed by the State of New Jersey and the Township of Mahwah as a result of the COVID-19 pandemic, the residents of Rio Vista Mahwah have not been afforded the opportunity to evaluate the impact that the proposed development will impose. Accordingly, the Petitioners respectfully request that the Planning Board adjourn the currently scheduled meeting, which is set to discuss and potentially approve the subject development, for ninety (90) days.
The requested adjournment is necessary for the Petitioners:
a. To identify the ramifications that this undertaking will have on the public health, safety, welfare, comfort, and convenience due to the density of the proposed development.
b. To understand the legal consequences and to mitigate the potential damages to Rio Vista Mahwah and its homeowners, the infringement of rights of adjacent properties due to the nature of the rezoning, avoid conflicts of interest, and to review the developer’s application to ensure that all procedural prerequisites and formalities were observed.
c. To ensure that the proposed development will not lead to short and long-term environmental repercussions and to study the toxic pollution, sanitation, landscape and other environmental hazards and concerns given the existing nature of the premises as a historic junkyard and construction site.
d. To define the present and anticipated problems that the proposed development may pose on the surrounding real property in our community and to allow the opportunity to implement remedial measures if necessary.
e. To reduce the creation of hazards to pedestrians, particularly to our community’s children, from the substantial increase in heavy traffic on otherwise quiet town roads and to consider the potential adverse effects on the value of the homes in Rio Vista Mahwah.
WHEREFORE, Petitioners respectfully ask that the May 24, 2021 meeting be adjourned for ninety (90) days.
