Resident Petition: Demand for Action on Ongoing Harassment — Anchorage at Marina Bay
Dear OMNI Management and Members of the HOA Board,
We, the undersigned residents of Anchorage at Marina Bay, submit this petition as a formal, collective complaint against the resident of 401 Jetty Drive (hereinafter "the subject resident"). We do so with urgency, and in unified voice, because the individual and institutional responses to date have been inadequate to protect the safety and well-being of this community.
BACKGROUND
This community has endured a prolonged and documented pattern of harassment, intimidation, threatening behavior, physical intimidation, and repeated violations of our CC&Rs by one resident. These incidents have been reported to OMNI, to the HOA Board, and to the Richmond Police Department — yet the behavior continues. The incidents span from 2021 through the present and involve more than fifteen (15) separate households.
DOCUMENTED VIOLATIONS OF THE CC&Rs
The incidents described in the attached Harassment Log constitute clear violations of the Anchorage at Marina Bay Declaration of Covenants, Conditions and Restrictions (CC&Rs), specifically:
- Section 4.14.4 (Offensive Activities) — prohibiting conduct that is hazardous, noxious, or offensive, and that obstructs or interferes with the rights of other Owners.
- Section 4.15 (Use of Common Area) — prohibiting nuisances or any act harmful or unreasonably offensive to other Owners within common areas.
- Section 4.6 (Invitees) — requiring Owners to be responsible for the conduct of those they bring onto the property and for compliance with all Project Documents.
- Section 4.8 (Parking / Vehicle Restrictions) — incidents include use of vehicles to intimidate, block, and threaten residents.
SUMMARY OF INCIDENTS
The attached Harassment Incident Log documents more than eighty (80) separate incidents reported by over fifteen (15) residents. These incidents include but are not limited to:
- Verbal assault, threatening language, and profanity directed at residents — including incidents involving minor children and pregnant women
- Physical intimidation — blocking sidewalks, driveways, and vehicles; bumping and shoving residents
- Threats of violence, including explicit threats to kill, harm with weapons (hatchet, machete), and threats made in front of witnesses
- Repeated unauthorized photography and filming of residents and their minor children in private and common areas
- Throwing a basketball at residents, vehicles, and garage doors — including while a child was present
- Reckless and dangerous driving within the complex, including swerving toward pedestrians and children
- Multiple violations of existing Civil Harassment Restraining Orders obtained by residents
DEMANDS
We, the undersigned, formally and collectively demand that OMNI Management and the HOA Board take immediate and decisive action, including:
- Issue a formal Notice and Hearing pursuant to Section 10.4.1 of the CC&Rs, with appropriate fines and penalties levied for each documented violation
- Suspend the subject resident's access to all common area recreational facilities pending resolution, as authorized under Section 10.4.1
- Engage legal counsel to explore all available remedies under the CC&Rs and California law, including injunctive relief
- Provide written confirmation to all signing residents within 14 days that action has been initiated
- Provide a written timeline of all steps being taken and expected outcomes
We acknowledge that the Board and OMNI may have limited authority to resolve matters that have escalated to criminal behavior. However, the HOA's obligation to enforce the CC&Rs is clear, and further inaction is no longer acceptable to this community.
The undersigned residents respectfully but firmly demand that this matter be treated with the urgency it warrants. We are prepared to pursue all available legal remedies if the Association fails to act.
