Honor Mother Nature! Rescind PAD in R-3

Blanket overlays on current zones are unfair and wrong. There are procedures in place for changing zoning on a case by case basis giving community members a say in whether a proposed zone change is appropriate. Well-designed affordable housing can be established in some Moab neighborhoods, but it must be designed to fit the existing density and the ability of the existing infrastructure to handle it.

The deadline for submitting material in evidence of rescinding the pad is Thursday June 20, 2019 at 8:00 A.M., or basically Wednesday or the wee hours of Thursday, to make the agenda of the June 25, 2019. Council meeting. Evidence can be letters e-mailed to Council members, Karen Guzman-Newton ([email protected]), Tawney Knutson-Boyd ([email protected] 435-260-8788) and Mike Duncan ([email protected] 720-281-2430) to convince them to have a change in heart and request a reconsideration. The Honorable Mayor Emily Niehaus can also put items on the agenda (mayor@moab city.org 435-259-5121) Letters of evidence need also be delivered to Sommar Johnson our City recorder e-mail unlisted 435-259-2683. You do not have to be an R3 resident to sign the petition and request the PAD be rescinded. The PAD currently covers R3,R4,C1,C2C3,C4,C5 and R2 is in the cross-hairs to be included at a latter date. We need two of the city council members that voted in favor to pass a motion to rescind the PAD in R-3 at the next meeting: Councilmembers Knuteson-Boyd, Guzman-Newton and Duncan. I feel it is important to slow this process down and come up with smart solutions rather than same old same old tired urbanisation of the Historic district of a rural town. Residents property rights should be more important than a developers profits.

Planned Affordable Development (PAD)—Approved "Discussion: City Attorney McAnany presented a brief overview of the editing process. Mayor Niehaus noted there were five or six developers interested in the possibility of PADs in the R-3 zone. Councilmember Guzman-Newton asked for clarification regarding the PAD application process and key staff. Councilmember Jones brought up a lack of specificity regarding stormwater and lighting requirements and his desire to strike vague language in the ordinance. McAnany stated language that was too strict would discourage affordable development. Councilmember Duncan and Mayor Niehaus suggested the language could be settled over time. Councilmember Derasary stated she would vote no due to the lack of a redlined version for public review before the vote. Motion and Vote: Councilmember Duncan moved to approve Proposed Ordinance 2019- 02 - Amending the City of Moab Municipal Code by Adding a New Chapter 17.68 Planned Affordable Development (PAD). Councilmember Guzman-Newton seconded the motion. The motion passed 3-2 aye with Councilmembers Knuteson-Boyd, Guzman-Newton and Duncan voting aye and Councilmembers Derasary and Jones voting nay" May 14, 2019

The PAD in R-3 has been proposed many times. Also rejected many times. Maybe a new planning department, with a new director, which the City now has, and more neighborhood input, could provide the Planning Commission and Council with better guidance. Nothing wrong with re-examining this IMO. We are overwhelmed with proposals for land use change and many of us have not paid attention to every issue, some have slipped by us. A breather, not a fight, is what's needed.

There are so many reasons against the PAD and so little comment space. The Council, and Mayor like to say "We have been working on the PAD for a couple of years now" to that I say so what, it was a bad idea to begin with, and it is a bad idea now. The R3 Historic Residential zone is the oldest residential zone in the valley and should be protected against extreme hi density development. As a retired General Contractor, and prior city planning commissioner, I fell I understand the situation quite well. I have been involved in historic restorations in the R3 and central business district, and take a certain pride in helping make Moab's history shine. It dose not take a great deal of sensitivity to walk the R3 and see it's value as an important part of what Moab is. The density level of the R3 is a property right, and possession of the property owners, and not a bargaining chip for the city to use to entice developers to build a couple affordable houses. Yes we require more affordable housing , but not at the expense of diminishing greenspace. Also we do not have the water required to support high density dwellings. Let's work together for more creative and innovative solutions .

Please reconsider your decision on PAD in R3 zones. Consider other options. It would be great to see high density housing in the commercial zones instead of high density overnight accommodations.

I understand the need for affordable housing. However, we do not have the water needed to support high density dwellings. It would also greatly diminish the quality of life for those in downtown Moab.

Rescind the PAD on R-3. Voting on the PAD for R-3 without public input is not acceptable. Kaki's suggestions are very reasonable.

Sorry in our fight to get the PAD taken out of R2 we did not all work together to protect ALL residential nieghbor hoods! Thank you Kaki.
