We, the undersigned, respectfully petition the appropriate local authorities to allow reasonable beach access to parking lots along the West End beach for licensed, local small businesses operating on Dauphin Island, including Shark and Shore, a land-based guide service.

Shark and Shore operates during non-peak beach hours, typically between 6:00 PM and 12:00 AM, providing guided, catch-and-release fishing experiences. These activities are conducted in partnership with NOAA, contributing to valuable marine conservation and research efforts.

Currently, restrictions on vehicle parking access to certain beach areas create significant challenges, particularly for clients with mobility limitations. Many customers are unable to walk long distances, making it difficult for them to participate in these services. We believe all individuals should have equitable access to recreational and educational opportunities on public beaches.

To address this issue, we propose the implementation of a structured permitting system for qualified local businesses. This system would:

Allow controlled vehicle parking access to designated beach parking lots

Apply only to licensed, tax-paying businesses contributing to the local economy

Require an appropriate screening and approval process

Limit impact by allowing minimal vehicle parking use in designated parking lots (typically one service vehicle and one client vehicle)

This approach ensures that access is both responsible and manageable while supporting small business operations and inclusivity.

Additionally, federal grant funding has been approved for the restoration of Dauphin Island’s West End Beach. According to grant guidelines, maintaining reasonable public access is a requirement. Section 5 (“Public Shores with Limitations”) specifies that beaches restricted to residents or select groups may be considered private and could risk non-compliance with federal requirements.

It is also important to note that access roads including Raphael Semmes, St. Stephens, Sam Houston, and Sehoy are identified in current GIS and parcel data as being owned by the City of Dauphin Island—not the Property Owners Association. These city-owned roads extend beyond POA property boundaries, which is a key factor in determining lawful public access.

Review current access restrictions

Consider the legal and funding implications of limiting public beach access

Work collaboratively with local businesses to establish a fair permitting system

This solution supports conservation, maintains compliance with federal requirements, promotes accessibility, and strengthens the local economy.
