Governor Bobby Jindal: Repeal Act 12! This law is wrong for many reasons, some of which are: 1. It takes away one more of our precious American personal freedoms - to build what we want on our own property. 2. It allows for enforcement officials to use cruel and unusual punishment by denying or disconnecting electricity from an accused code violator. Electric service is an absolute necessity in living in today's world! Depriving a family of this basic utility is a crime against humanity! 3. The law establishes the environment for abusive enforcement and excessive fees. Disconnect orders to electric companies are issued without giving the accused violator a trial in which they can defend themselves! Both the United states constitution and Act 12 provide for the legal system to determine guilt or innocence for any person accused of a crime. The enforcers of act 12 to not follow the legal procedure defined in act 12 - to seek injunctive relief in a district court or a mandamus from a district court - thereby violating the civil rights of the victim. 4. The law replaces God as the source of liberty. In our Declaration of Independence, God endows us with the unalienable right of liberty. Under act 12, liberty is meted out by the government for the liberty to build a house; the liberty to get electricity - essentially saying that the Government endows a citizen with liberty.. (For a fee!) We plead and urge you as governor of this state to repeal the oppressive Act 12 state building code law.
