The FBI had tools such like a subpoena to question witnesses, form of a Grand Jury and to record Clinton's testimony which is policy of the D.O.J. FBI knew knew beforehand that the server was wiped clean, devices were destroyed. Clinton swore under oath to a Federal Judge and two Congressional committees that all work related emails were returned. FBI found 17,800 emails that were not returned. Again, multiple examples of obstruction were uncovered and still Comey was unable to determine that this evidence violated U.S. codes and laws
