REMOVAL OF COUNCILOR TSWARELO PUDI OF WARD 89 IN EKURHULENI
Petition for the Removal of Councilor Tshwarelo Pudi, Ward 89, on Grounds of Poor Service Delivery, and Failure to Represent the Community, and Neglect of his Duties.
Submitted in terms of the Local Government: Municipal System Act 32 of 2000, Schedule 1: Code of Conduct for Councilors, and applicable municipal legislation.
We, the undersigned residents of Ward 89,in Ekurhuleni Metropolitan Municipality, hereby petition for the removal of Ward Councilor Tshwarelo Pudi from office due to his failure and persistent non-performance to provide adequate service to our community, failure to represent our interests, and repeated contraventions of the Code of Conduct for Councilors as contained in Schedule 1 of the Local Municipal System Act 32 of 2000 (“the Act”).
LEGAL BASIS FOR THIS PETITION
The petition is grounded in the below legislative principles and obligations:
Section 19 of the municipal System Act, which requires municipal to encourage and facilitate community participation in local government matters.
Section 73 of the Act, which obliges municipalities and political office to provide adequate services in a manner that is effective, accountable, effective, responsive and transparent.
GROUNDS OF REMOVAL
We respectfully request the removal of Councilor Tshwarelo Pudi, the elected Ward Councilor for Ward 89
Due to persistent and serious failures in the execution of his duties, including but not limited to the following:
1. Poor Service Delivery and Non-Responsive
(Contravention of Sections 19 and 79 of the Municipal Act)
The councilor has failed adequately to address and represent interests of Ward 89 in Council and relevant municipal structures.
2. Failure to Represent the Community
(contravention of Schedule 1, item 2 and 3)
The councilor has not effectively represented our community's interests in council meetings, leading to a lack of development and progress in our ward.
Lack of meaningful feedback, follow-up, or intervention on matters formally raised by residents.
3.Neglect of Duties
(Contravention of schedule 1 item 4)
The councilor has been repeatedly absent from community meetings, failed to respond to our calls and invites, and has not provided regular updates on council decisions and actions.
Unavailability and unwillingness to consult with the community on matters of concerns
4. Misrepresentation and Alleged Misleading of the Community
(Contravention of Schedule 1 items 2 and 7)
Providing information to the community regarding a developing matter that is allegedly inaccurate or misleading.
Such conduct has caused confusion, distress, and adverse consequences for residents.
The councilor has provided information to the community regarding ongoing or developing matters that is alleged to be inaccurate or misleading.
DEMAND FOR REMOVAL AND ACTION
In terms of Section 27 of the Municipal System Act and Schedule 1: Code of Conduct for Councilors)
We, the undersigned residents, demand that the municipal council take immediate action to remove Ward Councilor Tshwarelo Pudi from office and initiate the process for a by-election to elect a new councilor who will serve the community’s interests
Appropriate disciplinary action be taken against Tshwarelo Pudi
In conclusion, the continued failure of Councilor Tshwarelo Pudi to meet his legal, ethical, and constitutional obligations has left the residents of Ward 89 without effective representation. His conduct is inconsistent with the principles of democratic, accountable, and responsive local government as envisioned by the Constitution and Municipal Legislation.
We, therefore, respectfully and humbly urge the Council to act decisively and without.
